About modification of the Order of registration in the customs register of objects of intellectual property right which are protected according to the law

According to part three of Article 398 of the Customs code of Ukraine, the Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375, for the purpose of enhancement of order of registration in the customs register of objects of intellectual property right which are protected according to the law, I ORDER:

1. Make changes to the Order of registration in the customs register of objects of intellectual property right which are protected according to the law, No. approved by the order of the Ministry of Finance of Ukraine of May 30, 2012 648, registered in the Ministry of Justice of Ukraine on June 22, 2012 for No. 1034/21346 (further - the Procedure), having been reworded as follows it which is applied.

2. To provide to the State Customs Service of Ukraine till July 01, 2020:

creation and putting into operation of the new program and information complex "Customs Register of Objects of Intellectual Property Right" which will provide realization of provisions of the Procedure;

creation and commissioning on web resource of program and information service for owners which will provide realization of provisions of the Procedure;

completion of the corresponding program and information complexes for realization of provisions of the Procedure.

3. To provide to the State Customs Service of Ukraine on own web resource informing owners on date of commissioning the stipulated in Item 2 presents of the order of program and information complexes and services.

4. Concerning objects of the intellectual property rights registered in the customs register of objects of intellectual property right which are protected according to the law (further - the customs register), before entry into force of this order to determine that:

actions for assistance to protection of intellectual property rights on such objects of intellectual property right are applied before date of exception of such objects of the customs register;

such objects are excluded from the customs register in the cases established by Procedure;

prolongation of term of registration of such objects is performed by filing of application about assistance to protection of the property rights belonging to the owner on object of intellectual property right in form according to appendix 1 to the Procedure, with observance of requirements of the Procedure.

5. In accordance with the established procedure to provide to department of customs policy of the Ministry of Finance of Ukraine:

submission of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

6. This order becomes effective from the date of its official publication.

7. I reserve control of execution of this order and I assign to the acting as the Chairman of the State Customs Service of Ukraine Muratov I. N.

Order of registration in the customs register of objects of intellectual property right which are protected according to the law

I. General provisions

1. This Procedure establishes order of registration in the customs register of objects of intellectual property rights (further - PIS) which are protected according to the law, including the application form, the list of information and the documents enclosed to the application, procedure for giving and consideration of the application, entering of information into the customs register and its maintaining.

2. In this Procedure terms are used in such values:

assistance measures - provided by part one of Article 397 of the Customs code of Ukraine (further - the Code) the measures for assistance to protection of PIS applied to the goods suspected of violation of PIS;

the statement for registration of object of PIS in the customs register - the statement for assistance to protection of the property rights belonging to the owner on object of PIS which is represented in form according to appendix 1 to this Procedure, according to article 398 of the Code for the purpose of registration of such object in the customs register;
