About modification of some legal acts

The Parliament adopts this organic law.

Art. I. - In the Law on National Bank of Moldova No. 548/1995 (repeated publication: The official monitor of the Republic of Moldova, 2015, Art. No. 297-300, 544), with subsequent changes to make the following changes:

1. In part (Article 1 the word "branches" to replace 4) with the word of "department".

2. In Article 2:

to state concept "Bank" in the following edition:

"Bank - bank as it is determined in article 3 of the Law on activities of banks No. 202/2017.";

to exclude concept "Financial institution".

3. In Article 5:

Item d) parts (to state 1) in the following edition:

"d) licenses, exercises regulation and supervision on individual basis and, depending on circumstances, on the consolidated basis behind activities of banks legal entities of the Republic of Moldova and departments of banks of other states;";

add Article with part (6) the following content:

"(6) When implementing by National Bank of the functions provided by this law provisions of the Law on the basic principles of regulation of business activity No. 235/2006, of the Law on regulation of business activity by permission No. 160/2011, of the Law on implementation of single window in implementation of business activity No. 161/2011 and the Law on the state control of business activity No. 131/2012 are not applied.".

4. Part (1-1) Articles 7 to add with the words "and Chapter 3 of the Section V of the Law on activities of banks No. 202/2017".

5. In part (Article 10 of the word of "the banks which obtained licenses of National Bank, and branches of foreign licensed banks" shall be replaced with words 1) "licensed banks and departments of banks of other states which obtained licenses of National Bank".

6. In part (1) Article 11-1 of the word "parts (7) article 38 of the Law on financial institutions No. 550-XIII of July 21, 1995." shall be replaced with words "parts (4) article 144 of the Law on activities of banks No. 202/2017.".
