"3.4. The conclusion of lease agreements, agreements of free use concerning state-owned property of federal state institutions of criminal executive system is performed without carrying out tenders or auctions according to the procedure, determined by the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of execution of criminal penalties in case of simultaneous observance of the following requirements:
1) the specified state-owned property is provided to the lessee, loan recipient for the purpose of placement of production with attraction of work of convicts;
2) the lease agreement, the agreement of free use establish prohibition on delivery in the sublease of the specified state-owned property, transfer by the lessee, loan recipient of the rights and obligations according to such lease agreement, the agreement of free use to other persons, provision of the specified state-owned property in free use to other persons, pledge of the granted leasehold rights, the rights following from the agreement of free use;
