About modification and amendments in the Criminal code of the Republic of Armenia

Article 1. In article 222 of the Criminal code of the Republic of Armenia of April 18, 2003 ZR-528-N (further - the Code):

To exclude 1) from part 1 of the word "or participation in the assaults committed by gang";

Part 2 after the words "Participation in Gang" to add 2) with the words "or participation in the assaults committed by gang";

To add 3) with parts 3 and 4 of the following content:

"3. The acts provided by the first or second part of this Article which are made:

1) with use of official capacity;

2) with involvement of the minor;

3) person having the highest status of criminal hierarchy

are punished by imprisonment from twelve to twenty years with confiscation of property or without it.

4. The person who voluntarily reported to criminal prosecution authorities about the participation in gang and promoting suppression of its activities is exempted from criminal liability if its actions do not contain other actus reus.".

Article 2. In article 223 of the Code:

Heading after the words "Creation of Criminal Cooperation" to add 1) with the words "or management";

Part 3 to state 2) in the following edition:

"3. The acts provided by the first or second part of this Article which are made:

1) with use of official capacity;

2) with involvement of the minor;

3) person having the highest status of criminal hierarchy

are punished by imprisonment from ten to fifteen years with deprivation of the right to hold certain positions or to be engaged in certain activities no more than three years with confiscation of property or without it.";
