About modification and amendments in the Code of penal procedure of the Republic of Armenia

Article 1. Regarding 1 Article 34 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further – the Code) the words "Body of Inquiry, Investigator and Prosecutor" shall be replaced with words "Criminal prosecution authorities within the powers".

Article 2. To add part 2 of article 57 of the Code with Item 5.1 of the following content:

"5. 1) in case, stipulated in Item 5 parts 3 Articles 53 of this Code, results of execution of the decision on seizure of correspondence, post, cable and other messages, listening of telephone conversations send directly to body of pretrial investigation, having immediately informed of it the prosecutor;".

Article 3. To add article 282 of the Code with part 3 following of content:

"3. Body of inquiry, the investigator sends the copy of the decision on initiation of the petition to the supervising prosecutor. The decision (copy) on initiation of the petition for application of measure of procedural coercion, stipulated in Article the 280th of this Code, can be sent to court and to the supervising prosecutor by electronic method.".

Article 4. In article 283 of the Code:

Part 1 to state 1) in the following edition:

"1. Petitions are considered by the judge solely. The petition for application of procedural coercion is considered with participation of the official who gave it or his representative on the closed judicial session. The official who submitted the petition, or his representative or the prosecutor participate in consideration of the petition for implementation of investigative actions upon the demand of court or at the initiative of the official who submitted the petition or the prosecutor.";

To add 2) with part 6 of the following content:

"6. In day of decision making the court transfers him to the body performing production which without delay, but no later than within 12 hours sends it to the supervising prosecutor.".
