About change of the Law of the Republic of Belarus "About labor protection"

Article 1. Bring in the Law of the Republic of Belarus of June 23, 2008 No. 356-Z "About labor protection" the following changes:

1. In Article 1 part one:

to state the paragraph of the seventh in the following edition:

"the work permit on performance of works with the increased danger (further - the work permit) - the task for preparation and the performance of works with the increased danger of the established form which is drawn up on paper and determining the name of works, the place, terms and time of their accomplishment, action for preparation for performance of works, safe performance of works, cast of works, person (persons) responsible of works, (responsible) for preparation, person (persons) responsible (responsible) for safe performance of works, other requirements providing safe performance of works;";

the eleventh to exclude the paragraph;

the thirteenth to state the paragraph in the following edition:

"rules on labor protection - the technical regulatory legal act containing the requirements for labor protection aimed at providing the healthy and safe working conditions working obligatory for execution by all employers in case of accomplishment of any kinds of works by them, activities implementation including in case of construction (designing, reconstruction) and operation of objects, designing of machines, mechanisms and other equipment, development of engineering procedures, production organization and work;";

2. State Article 2 in the following edition:

"Article 2. Legal regulation of the relations in the field of labor protection

The relations in the field of labor protection are governed by the legislation on labor protection, and also the international treaties of the Republic of Belarus and international legal acts constituting the right of the Eurasian Economic Union including the technical regulations of the Customs union and Eurasian Economic Union containing requirements for labor protection.

The legislation on labor protection is based on the Constitution of the Republic of Belarus and consists of this Law, the Labor code of the Republic of Belarus, the Civil code of the Republic of Belarus, other regulatory legal acts governing the relations in the field of labor protection including the technical regulatory legal acts which are according to legal acts and the orders of the Government of the Republic of Belarus obligatory for observance.

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.".

3. In Article 4:

state part one in the following edition:

"Requirements for labor protection - the normative legal instructions directed to the preserving life, the health and working capacity working in the course of labor activity, containing in regulatory legal acts, including the technical regulatory legal acts which are according to legal acts and the orders of the Government of the Republic of Belarus obligatory for observance, technical regulations of the Customs union and Eurasian Economic Union, local legal acts.";

part third after words "technical regulatory legal acts," to add with words "technical regulations of the Customs union and Eurasian Economic Union,".

4. In Article 5:

the fourth to state the paragraph in the following edition:

"the complex solution of tasks on improvement of conditions and the labor protections by realization of package of measures directed to improvement of conditions and labor protection taking into account other directions of economic and social policy, achievements in science and technology;";

after the paragraph of the fourth to add Article with the paragraph of the following content:

"implementation of management systems labor protection;";

the ninth to state the paragraph in the following edition:

"interaction of the republican state bodies and other state organizations subordinated to the Government of the Republic of Belarus, the controlling (supervising) bodies, labor unions (further - labor unions), employers concerning labor protection;".
