About industrial financial groups in Ukraine
This Law determines procedure for creation, reorganization and liquidation of industrial financial groups in Ukraine, transnational industrial financial groups, and also financial and economic conditions of their activities.
The terms used in this Law have the following value:
1. The Industrial Financial Group (IFG) - consolidation which can include the industrial enterprises, agricultural enterprises, banks, scientific and project institutions, other organizations and the organizations of all patterns of ownership aiming at profit earning and which is created according to the decision of the Government of Ukraine for certain term for the purpose of implementation of state programs of development of priority industries of production and structural adjustment of economy of Ukraine, including programs according to interstate agreements, and also productions of end products.
2. The PFG head enterprise - the company created according to the legislation of Ukraine which makes end products of PFG performs its sale, pays taxes in Ukraine and officially represents the interests of PFG in Ukraine and beyond its limits. The PFG head enterprise loses the right to any privileges on the tax matters which it had or can have according to the current legislation of Ukraine.
3. The participant of PFG - the company, bank or other scientific or project institution, the organization created according to the legislation of Ukraine or the foreign legal entity who is part of PFG makes intermediate products of PFG or provides banking and other services to participants and the PFG head enterprise and aims at profit earning.
4. End products of PFG - products, including scientific and technical documentation and other objects of intellectual property right for the purpose of which production PFG is created.
