About modification and amendments in the Penitentiary code of the Republic of Armenia

Article 1. In Article 52 of the Penitentiary code of the Republic of Armenia of December 24, 2004 (further - the Code):

Part 3 to state 1) in the following edition:

"3. During serving of disciplinary arrest to the convict it can be prohibited:

1) obtaining and making of money transfers, except as specified receipts of necessities;

2) obtaining and sending transfers, sending and packets, except for case of receipt of necessities;

3) participation in civil transactions;

4) appointments, except as specified, provided by the law;

5) use of telephone communication.";

To add 2) with parts 3.1-3.3 following of content:

"3.1. During serving of disciplinary arrest the convict is forbidden to work.

3.2. The restrictions provided by part 3 of this Article are applied by the motivated decision of the commander of the disciplinary battalion or person fulfilling its duties on application of measure of punishment. During stay in punishment cell more than one restriction, provided by part 3 of this Article can be applied.

3.3. In case of application of each restriction provided by part 3 of this Article shall be proved causal relationship between the allowed violation and the applied restriction and reasonable need of achievement of the pursued lawful purpose by restriction application.".

Article 2. In article 59 of the Code:

Part 2 to state 1) in the following edition:

"2. During stay in punishment cell obtaining and sending money transfers, except as specified receipts of necessities can be prohibited the convict.";

To add 2) with part 2.1 following of content:

"2.1. During stay in punishment cell the convict is forbidden to work.".

Article 3. To add part 1 of article 96 of the Code after the word "collection" with words ", and collection was not extinguished".
