1. Bring in the order of the Government of the Republic of Kazakhstan of November 28, 2015 No. 961 "About approval of Rules of payment of the monthly perpetual maintenance to the judge staying in resignation" (SAPP of the Republic of Kazakhstan, 2015, Art. No. 59-60-61, 480) the following changes:
in the Rules of payment of the monthly perpetual maintenance to the judge staying in resignation, approved by the specified resolution:
2) of Item 2 to state the subitem in the following edition:
"2) the receiver of the monthly perpetual maintenance – the judge who is staying in resignation, including retired till January 1, 2016 according to Items 1, of 1-1 and 2-1 article 35 of the Constitutional law, reached the retirement age established by the Law of the Republic of Kazakhstan "About provision of pensions in the Republic of Kazakhstan", and submitted the application to authorized body on organizational and to material logistics of activities of the Supreme Court of the Republic of Kazakhstan, local and other courts;";
state Item 23 in the following edition:
"23. Payment of the monthly perpetual maintenance stops in case of the termination of resignation of the judge on the bases, stipulated in Item 3 articles 35 of the Constitutional law.
In cases of death or the introduction in legal force of the judgment about the announcement of the judge staying in resignation, the dead, payment of the monthly perpetual maintenance is performed till month of death inclusive.".
2. This resolution becomes effective after ten calendar days after day of its first official publication.
