About modification of the Regulations on procedure for submission of data on structure of property of bank

According to Articles 7, 15, 56 Laws of Ukraine "About the National Bank of Ukraine", to the Law of Ukraine "About banks and banking activity", for the purpose of enhancement of procedure for submission of data on structure of property of the Board of the National Bank of Ukraine DECIDES: bank

1. Make to the section I Regulations on procedure for submission of data on structure of property of the bank approved by the resolution of Board of the National Bank of Ukraine of May 21, 2015 No. 328 (with changes), such changes:

Paragraph two of Item 5 to replace 1) with three new paragraphs of such content:

"The National Bank has the right to recognize structure of property of bank opaque in case:

1) impossibility to establish persons/persons who performs (ют) considerable influence on management or activities of bank, or

2) availability in such structure of property of persons/persons who are acknowledged/are acknowledged as National Bank owners/owners of essential participation in bank if such person / persons does not approve with National Bank the purchase of essential participation in the bank according to the procedure determined by the legislation of Ukraine.";

2) after Item 6 to add the Section with new Item 6-1 of the following content:

"6-1. The financial/property status of person which is part of ten largest final key participants in structure of property of bank is subject to assessment according to Item 6 of the Section I of this provision for clarification of transparency of structure of property of bank, it is considered satisfactory if:
