About introduction of amendments to the Law on the public pension system No. 156/1998
The Parliament adopts this organic law.
Art. I. – In the Law on the public pension system No. 156/1998 (repeated publication: The official monitor of the Republic of Moldova, 2004, Art. No. 42-44, 247), with subsequent changes to make the following changes:
1. In part (1) Article 2 of the word "living in the Republic of Moldova", to exclude.
2. Add Article 31 with part (21) the following content:
"(21) Person which left for permanent residence to the state which did not sign the agreement on social insurance with the Republic of Moldova the identification document of national passport system and other necessary documents submits the application for award of pension which without fail is registered to territorial authority of social insurance at the last permanent address in the Republic of Moldova.".
3. In Article 34:
in part (1) words "payment service provider". shall be replaced with words "the payment service provider in the territory of the Republic of Moldova.";
in part (words of "six months" shall be replaced with words 3) "twelve months".
4. State Article 36 in the following edition:
"Article 36. Pension payment to persons who went abroad on permanent residence
(1) Person who went abroad on permanent residence has pension entitlement according to this law.
(2) If competent person receives pension in the Republic of Moldova, constantly living abroad, each 12 months it shall direct to National cash desk of social insurance the certificate on life in the procedure provided by the Government. If the receiver of pension represents or directs the certificate on life after 12 months, pension payment is resumed from the date of suspension.
(The Receiver of pension draws up 3) and signs the certificate on life in diplomatic representation / consular establishment of the Republic of Moldova in the territory of the state of accommodation or in territorial subdivisions of National cash desk of social insurance which certify the fact of signing of the document personally the owner of the social rights.
