About modification of some legal acts
The Parliament adopts this organic law.
Art. I. - In the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes:
1. Add Article 178 with part (3-1) following of content:
"(3-1) Measures of restraint provided in parts (1) and (2), can be ordered for the term of no more than 12 months in total to the person accused, the defendant in case of crime execution for which the law prescribes custodial sanction for the term of no more than 12 years, or 24 months in total to the person accused, the defendant for crime execution for which the law prescribes custodial sanction for the term of more than 12 years.".
2. Part (articles 473 after words to "the judge on criminal prosecution" to add 1) with words of "degree of jurisdiction".
3. Add the code with Articles 473-2-473-4 of the following content:
"Article 473-2. The claim to administration of penal institution concerning the conditions of keeping which are seriously infringing the rights of the convict or person containing under provisional attachment
(1) the Claim to administration of penal institution concerning conditions of keeping which in the light of law of the European Court of Human Rights infringe at the rights of the convict or person containing under provisional attachment, the Conventions on human rights protection guaranteed by Article 3 and fundamental freedoms can be submitted by the convict or person containing under provisional attachment, personally or through the lawyer in degree of jurisdiction in the location of penal institution in which there is convict or person containing under provisional attachment or, on circumstances, from which they are exempted.
