About entering of amendment into the Civil code of the Republic of Armenia

Article 1. To add the civil code of the Republic of Armenia of May 5, 1998 with Chapter 14.2 of the following content:
"Chapter 14.2. Neighbour's right
Article 225.3. The relations which arose between neighbors
1. Rules of this Chapter govern the relations connected with mutual impact of neighbour's sites or other real estate, water use, land surveying and other relations arising between neighbors.
2. That parcel of land or any other real estate which has any impact on other parcel of land or any other real estate is neighbour's.
3. Owners of the real estate which is considered neighbour's and also their legal owners, in addition to the rights and obligations provided by the law have the obligation of manifestation of mutual respect.
Article 225.4. Admissible impact
1. The owner or the legal owner of the real estate which is considered as neighbour's cannot prohibit impacts of gas, vapor, smell, soot, smoke, noise, heat from the neighbour's territory if it does not interfere with use of its property or is caused by natural use of the property characteristic of this territory, or such impact is insignificant.
2. If impact exceeds the size established by standard rates and the natural use of property characteristic of this territory and cannot be eliminated with reasonable method, and the owner is forced to stand him, then he can demand from the owner of the neighbour's territory of cash compensation.
3. The size, terms and procedure for compensation are determined by the consent of the parties. If consent was not reached, the size, terms and procedure for compensation determines court also taking into account property status of person giving compensation.
