About modification and amendments in the Code of the Republic of Armenia about subsoil

Article 1. In item 4 of part 4 of article 13 of the Code of the Republic of Armenia about subsoil of November 28, 2011 (further - the Code) words "the state inspectorate for subsoil, the state inspectorate for conservation" shall be replaced with words to "the inspection body exercising control in the field of subsurface use and protection".

Article 2. In article 17 of the Code:

1) Items 2, 16 and 17 parts 1 to recognize invalid, and in Item 10 of the word "management and control" to replace with the word "management";

Part 2 to state 2) in the following edition:

"2. In the field of environmental protection in connection with subsurface use treats competences of authorized body of public administration in conservation:

1) participation in forming of state policy of environmental protection in the field of subsurface use;

2) application of restrictions, stipulated by the legislation the Republic of Armenia on environmental protection in connection with subsurface use;

3) conducting examination of impact on the environment of projects, programs for subsurface use, projects of dismantle of mining complex, preservation, closing of fields and refusal of them;

4) decision making on capital utilization of environmental protection, calculation of the amount of assignments, carrying out recultivation works;

5) development of procedure of monitoring of the territory of mining, arrangement of the production dumps which arose in the course of production, and for the purpose of safety and health of the population of the municipalities adjoining to them;

6) approval of the plan or program of monitoring of the environment at impact evaluation stage on the environment;

7) development of procedure for inventory count of objects of the closed subsurface use waste;
