About modification and amendments in article 46 of the Law on Single Central Securities Depository No. 234/2016

In article 46 of the Law on Single Central Securities Depository No. 234/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 343-346, 711), with subsequent changes and amendments, to make the following changes and additions:

in part (8):

the subitem a) Item 1) to add with words ", including considerations of claims of owners of securities and comparison, on circumstances, these registers of registration societies / keepers and/or these state information resources;";

add part with Items 1-1) - 1-3), 2-1) and 3-1) following of content:

"1-1) for implementation of the procedure of verification of registers of owners of securities of financial institutions and insurance companies the National commission on the financial market approves the forecast budget for each issuer taking into account number of shareholders;

1-2) money calculated by the National commission on the financial market according to Item 1-1) are paid by financial institution and the insurance company at least in 10 days prior to the procedure of check. If actually incurred expenses on verification of the register of owners of securities exceed the calculated expenses, the financial institution and the insurance company shall bring difference within 10 days from the moment of receipt of the notification of the National commission on the financial market. Incomplete or untimely transfer into account of the National commission on the financial market attracts imposing of penalty fee in the amount of, established in part (3) article 6 of the Law on the National commission on the financial market No. 192/1998;
