About modification of the Regulations on competitive selection of subjects of estimative activities

According to article 5 of the Law of Ukraine "About Fund of state-owned property of Ukraine", article 10 of the Law of Ukraine "About assessment of property, property rights and professional estimative activity in Ukraine", according to Item 18 of the Technique of assessment of property approved by the resolution of the Cabinet of Ministers of Ukraine of December 10, 2003 No. 1891 (in edition of the resolution of the Cabinet of Ministers of Ukraine of November 25, 2015 to No. 1033), for the purpose of enhancement of procedure for attraction of estimative activities by privatization authorities of subjects - subjects of managing on competitive basis I ORDER:

1. Make changes to the Regulations on competitive selection of subjects of estimative activities approved by the order of Fund of state-owned property of Ukraine of December 31, 2015 No. 2075, registered on January 15, 2016 for No. 60/28190, having been reworded as follows it which is applied the Ministry of Justice of Ukraine.

2. To provide to department of assessment of property, property rights and professional estimative activity submission of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

3. This order becomes effective from the date of its official publication.

4. The competitions on selection of subjects of estimative activities announced before entry into force of this order are performed and come to the end according to the Regulations on competitive selection of subjects of estimative activities approved by the order of Fund of state-owned property of Ukraine of December 31, 2015 No. 2075, registered in the Ministry of Justice of Ukraine on January 15, 2016 for No. 60/28190, in the edition operating at the time of their announcement.

5. To impose control of execution of this order on the vice-chairman of Fund of state-owned property of Ukraine according to distribution of functional obligations.

Regulations on competitive selection of subjects of estimative activities

I. General provisions

1. This Provision establishes the procedure of competitive selection of subjects of estimative activities - the subjects of managing recognized as those according to the Law of Ukraine "About assessment of property, property rights and professional estimative activity in Ukraine"; subjects of estimative activities in the field of assessment of the lands recognized as those according to the Law of Ukraine "About assessment of lands" (further - subjects of estimative activities).

2. Fund of state-owned property of Ukraine (further - Fund) and its regional departments (further - privatization authorities) apply the procedure of competitive selection of subjects of estimative activities if they are customers of services in independent assessment of property or works on expert money value of the parcels of land (further - services in property assessment) according to requirements of the legislation, and the cost of rendering services in assessment of property is less than part one of article 2 of the Law of Ukraine established in the paragraph the second "About public purchases".

3. In this Provision terms are used in such values:

documents of rather practical experience of performance of works by assessment - documents concerning experience of practical activities according to property, similar objects which assessment will be performed by the winner of tender: the copy of the agreement (the copy of agreements) on provision of services by assessment together with the copy of the act of acceptance transfer of assessment works, the copy of the conclusion about assessment project cost, the original or the copy of the review constituted by the reviewer who works in privatization authority, either the original or the copy of the review constituted by advisory council of self-regulatory organization of appraisers who are classified by the signs specified in paragraphs second or third Item 67 of the National standard No. 1 "General bases of assessment of the property and property rights" approved by the resolution of the Cabinet of Ministers of Ukraine of September 10, 2003 No. 1440;

the tender documentation - the competitive offer, supporting documents and documents of rather practical experience of performance of works on assessment and appraisers who will be involved in performance of works by assessment and signing of the valuation report of property (expert money value of the parcel of land);

the competitive offer - the proposal of the participant of tender concerning the cost of rendering the services in assessment, costing connected with provision of such services, and also term of their accomplishment (in calendar days) if it was not determined in information on carrying out tender;

objects of assessment of the first level of complexity - the building (including what is formed by complexes); rooms; the parcels of land under buildings (in particular such that is formed by complexes); vacant parcels of land; buildings (as separate objects); objects of construction in progress; serial equipment (separate object or several objects); custom-made equipment (separate object or several objects); wheel vehicles; navigable means; aircraft; inventories (including goods);

objects of assessment of the second level of complexity - the real estate units associated with business; complete property complexes or their assets; securities; corporate laws; intangible assets; rights to claim; unique and difficult objects (in particular, the objects having more than 10 thousand non-current assets, or located on significant amount of the parcels of land within one region, or located in different regions, or located on the parcels of land which have different purpose and so forth);

the applicant - the subject of estimative activities who showed willingness to take part in tender and gave to the privatization authority the tender documentation in time provided in promulgated according to Item 2 of the Section II of this provision of information on carrying out tender;
