About introduction of amendments to the Law of Ukraine "About public purchases" and some other laws of Ukraine concerning implementation of monitoring of purchases

The Verkhovna Rada of Ukraine decides:

I. Introduce in the Law of Ukraine "About public purchases" (Sheets of the Verkhovna Rada of Ukraine, 2016, No. 9, Art. 89 with subsequent changes) the following changes:

1. In Article 1 part one:

add with Item 1-1 of the following content:

"1-1) automatic indicators of risks - criteria with the parameters set in advance which use gives the chance automatically to perform the choice of procedures of the purchases containing signs of violations of the law in the field of public purchases";

state Item 11 in the following edition:

"11) purchase monitoring - the analysis of observance by the customer of the legislation in the field of public purchases at all stages of purchase for the purpose of prevention of violations of the law in the field of public purchases".

2. The second Article 2 to state part in the following edition:

"2. Conditions, procedure and procedures of purchases of goods, works and services are regulated only by this Law and/or the Law of Ukraine "About features of implementation of purchases of goods, works and services for secured provision of requirements of defense", except the cases provided by this Law and cannot be established or change other laws of Ukraine, except the laws containing only regulations of introduction of amendments to this Law and/or in the Law of Ukraine "About features of implementation of purchases of goods, works and services for secured provision of requirements of defense".

3. Third of Article 7 to state part in the following edition:

"3. The central executive body realizing state policy in the field of the state financial control exercises control in the field of public purchases within the powers determined by the Constitution, this Law and other laws of Ukraine.

The Antimonopoly Committee of Ukraine and Audit Chamber exercise control in the field of public purchases within the powers determined by the Constitution and the laws of Ukraine.
