About modification and amendments in the Law on social benefit No. 133/2008

The Parliament adopts this organic law.

Art. I. – In the Law on social benefit No. 133/2008 (Official monitor of the Republic of Moldova, 2008, No. 179, of the Art. 625), with subsequent changes and amendments, to make the following changes and additions:

1. In Article 3:

state the concept "needy family" of the following edition:

"the needy family – family which has comprehensive average monthly income less than the minimum guaranteed monthly income and which has score on welfare measures less or is equal to the threshold established for family welfare assessment;";

add Article with concept of the following content:

"works for the benefit of community – the works, useful to community, organized, managed and controlled primary.".

2. In Article 5:

Item c) parts (to add 1) with words "and which do not refuse participation in works for the benefit of community;";

add Article with part (1-1) following contents:

"(1-1) If the minor has full legal capacity according to Article 20 of the Civil code and confirms one of the employment statuses provided in part (1) this Article, then he is considered adult for the purpose of this law. Otherwise he is considered child in accordance with the terms, established by the Government.";

Item a) parts (to state 3) in the following edition:

"a) do not live on the residential address that is confirmed with the social questionnaire;".

3. Add Article 7 with part (2-1) following of content:

"(2-1) For the family members specified in part (1-1) Articles 5, the size of the minimum guaranteed monthly income are calculated depending on the confirmed status – the adult or the child.".
