About approval of Changes in Regulations on order of registration of payment systems, members of payment service providers and operators of services of payment infrastructure

According to to Articles 7, 15, 56 of the Law of Ukraine "About the National Bank of Ukraine" and for the purpose of enhancement of order of registration by the National Bank of Ukraine of payment systems, settlement systems, members of payment service providers and operators of services of payment infrastructure the Board of the National Bank of Ukraine decides:

1. Approve Changes in the Regulations on order of registration of payment systems, members of payment service providers and operators of services of payment infrastructure approved by the resolution of Board of the National Bank of Ukraine of February 4, 2014 No. 43, registered in the Ministry of Justice of Ukraine on March 5, 2014 for No. 348/25125 (with changes) (further - No. Provision 43) which are applied.

2. To payment institutes of payment systems within 30 calendar days from the date of entry into force of this resolution to provide to the National Bank of Ukraine information on the operator of services of payment infrastructure of resident according to the procedure determined by Item 13 of the Section I of the Provision No. 43.

3. To department of financial controlling (A.V. Strinzha), to Department of licensing (Bevz A. A.) till February 28, 2018 to bring rates for services in registration and licensing into compliance with requirements of the Provision No. 43.

4. To impose control over the implementation of this resolution on the First Deputy Chairman of the National Bank of Ukraine Smoliya Ya. V.

5. The resolution becomes effective from the date of, its official publication following behind day, except the paragraph of the fourth Item 7 of the Section II and paragraph two of item 4 of the Section VII of the Provision No. 43, which become effective since February 28, 2018.

Changes in Regulations on order of registration of payment systems, members of payment service providers and operators of services of payment infrastructure

1. In the Section I:

Item 2 to state 1) in the following edition:

"2. Requirements of this provision do not extend to payment systems which payment institute is the National Bank, and also regarding registration of operators of services of payment infrastructure - to payment institutes of payment systems / participants of the payment systems performing functions of operators of services of payment infrastructure only for this payment system / this member of payment service provider.";

2) in Item 6:

after the paragraph of third to add Item with two new paragraphs of the following content:

"The scanned copy of each separate document remains as the separate file;

the file shall have the short name Latin letters reflecting content and details of the document;".

With respect thereto the fourth - the sixth to consider paragraphs respectively paragraphs the sixth - the eighth;

state the eighth paragraph in the following edition:

"Electronic copies of documents are represented to National Bank on digital data carriers [compact disks (CD/DVD) or USB flash drives] or go by e-mail of National Bank taking into account technical capabilities of this system (on condition of connection of payment institute of payment system, the member of payment service provider, the operator of services of payment infrastructure to system of e-mail of National Bank).";

Item 7 to state 3) in the following edition:

"7. The National Bank has the right to demand from payment institute of payment system, the member of payment service provider and the operator of services of payment infrastructure of provision of additional documents, information or explanations for the purpose of refining of the data specified in the documents submitted to National Bank and necessary for adoption of decisions by National Bank according to this Provision.";

4) after Item 7 to add the Section with four new Items 8 - 11 following contents:

"8. The National Bank has the right to suspend consideration of the documents submitted according to requirements of this provision in case of identification of circumstances which can influence adoption of the relevant decision by National Bank, before clarification of such circumstances, but no more than for 30 working days. The National Bank notifies payment institute of payment system, the member of payment service provider and operator of services of payment infrastructure on suspension of consideration of documents within five working days from the date of adoption of such decision (the decision is made by the authorized person of National Bank).

9. The National Bank has the right to extend the term of consideration of documents determined by this Provision according to the reasonable address of payment institute of payment system, the member of payment service provider and operator of services of payment infrastructure and to establish the term for which consideration term is extended. The National Bank notifies payment institute of payment system, the member of payment service provider and operator of services of payment infrastructure on prolongation of term of consideration of documents within five working days from the date of adoption of such decision (the decision is made by the authorized person of National Bank).

10. The National Bank has the right to provide notes and offers to the documents filed according to requirements of this provision if they do not conform to requirements of the legislation of Ukraine, regulatory legal acts of National Bank, including this provision and to establish term for their processing.

The National Bank stops the term of consideration of the documents determined by this Provision, before obtaining finished according to paragraph one of Item 10 of the Section I of this provision of documents and/or additional documents / information stipulated in Item the 7th the Section I of this provision, and recovers it after receipt of all modifed documents and information.

11. The National Bank has the right to return on completion the documents submitted according to requirements of this provision in case of representation of incomplete document package and/or discrepancy of the submitted documents to requirements of the legislation of Ukraine and regulatory legal acts of National Bank what in writing notifies payment institute of payment system on, the member of payment service provider and the operator of services of payment infrastructure with indication of the bases of such return (the decision is made by the authorized person of National Bank).

The payment institute of payment system, the member of payment service provider and operator of services of payment infrastructure has the right to give repeatedly to National Bank the document package provided by this Provision after elimination of the reasons which formed the basis for return of documents.".

With respect thereto 8, 9 to consider Items respectively Items 12, 13;

Item 12 to state 5) in the following edition:

"12. Payment institutes of payment systems, members of payment service providers and operators of services of payment infrastructure, in case of provision of services on money transfer intended to use the website, the commercial (corporate) name, trade brand / sign for goods and services, different from their official name, shall at least in 15 working days prior to use such/such the web website/trademark in writing report to National Bank their name / designation.";

6) after Item 12 to add the Section with new Item 13 of the following content:

"13. Payment institutes of payment systems shall within 10 working days from the date of the beginning/termination of use in payment system (including members of payment service provider) services of the operator of services of payment infrastructure of resident in writing to notify on it National Bank.

The notification shall contain information relatively:

1) the operator of services of payment infrastructure providing services in payment system:

full and abbreviated name;

identification code of the legal entity in the Unified state register of the companies and organizations of Ukraine (further - code on EGRPOU);

location;

commercial (corporate) name;

trade brand / sign for goods and services (in the presence);

name of the website (in the presence);

date of the beginning/termination of provision of services by the operator of services of payment infrastructure;

2) the operator of services of payment infrastructure providing services to the member of payment service provider;

full and abbreviated name;

EGRPOU code;

location;

commercial (corporate) name;

trade brand / sign for goods and services (in the presence);

name of the website (in the presence);

date of the beginning/termination of provision of services by the operator of services of payment infrastructure, and also the name of the participant, uses its services.".
