About modification and amendments in some legal acts

The Parliament adopts this organic law.

Ct.I. – In the Law on entrepreneurship and the companies No. 845/1992 (Monitor of Parliament of the Republic of Moldova, 1994, No. 2, of the Art. 33), with subsequent changes and amendments, to make the following additions:

1. Add Article 1 with Item 1-1 of the following content:

"1-1. Social entrepreneurship is one of types of business activity which main objective is the solution of social problems for the benefit of community. Provisions of Chapters I-VI are applied to activities in the field of social entrepreneurship in that measure in what they do not contradict provisions of Chapter VI-1.".

2. Add the law with Chapter VI-1 of the following content:

"Chapter VI-1. Social entrepreneurship and social company

Article 36-1. Social entrepreneurship

1. The activities in the field of social entrepreneurship performed by the social companies and the integration social companies are directed to improvement of living conditions and provision of perspectives for persons from socially vulnerable segments of the population by strengthening of economic and social unity, including at the level of local communities, assistance of labor employment, development of social services for the benefit of community, expansion of social integration.

2. Non-profit organizations (public associations, funds, religious cults and private institutions) have the right to perform activities in the field of social entrepreneurship after receipt of the status of the social company or the integration social company in case of observance of conditions of Articles 36-2 and 36-3.

3. Socially vulnerable segments of the population needy persons and families are recognized as it is determined by the Law on the public assistance No. 547/2003.

4. Activities in the areas directed on belong to activities in the field of social entrepreneurship:

a) creation of workplaces and employment mainly persons from socially vulnerable segments of the population;

b) protection and promotion of the rights of persons with limited opportunities and their families with the purpose of their social integration;
