About approval of the Regulations on the simplified procedure for customs clearance of some types of goods and about modification of the Order of State Customs Service of Ukraine of 09.07.97 No. 307

1. Approve Regulations on the simplified procedure for customs clearance of some types of goods which are applied.

2. Ceased to be valid according to the Order of the Ministry of Finance of Ukraine of 30.05.2012 No. 651

3. To management of customs regimes (V.V.'s Hare) and Management of legal work (Budakov A. Yu.) provide provision of this order on state registration in the Ministry of Justice of Ukraine.

4. Information analytically to customs authority (Shulyak V. P.) in 15-day time after commissioning of this order to finish the software taking into account requirements of Item 2 of this order.

5. Determine that this order is applied from day of entry into force of the Customs code of Ukraine.

6. To impose control over the implementation of the order on the deputy Chairmen of Service of Ivanyuk M. M.

Regulations on the simplified procedure for customs clearance of some types of goods

This Provision is developed for the purpose of simplification of procedure for customs clearance of the goods specified in Article 79 of the Customs code of Ukraine which move through customs border of Ukraine the companies.

1. General provisions

1.1. In this Provision terms are used in such value:

measures of non-tariff regulation - administrative measures of regulation of foreign economic activity: licensing, quoting, registration of the external economic agreements (contracts), certification of goods and so forth;

goods of the humanitarian assistance - the target address unpaid help in natural form which goes foreign and domestic donors for humane motives to receivers of the humanitarian assistance in Ukraine or abroad which need it in connection with social vulnerability, material neediness, financial hardship, emergence of extraordinary condition, in particular owing to natural disaster, accident, epidemic or epizooty, the environmental, technogenic and other disasters creating threat for life and health of the population or with serious illness of particular physical persons. Goods are recognized the humanitarian assistance according to the procedure, established by the legislation of Ukraine;

goods of the international technical assistance - goods which according to international treaties of Ukraine are provided by donors on unpaid basis to Ukraine for implementation of programs, projects of the international technical assistance for the purpose of carrying out reforms and program implementation of social and economic development of Ukraine;

goods which have limited storage duration, - goods which suitability term to consumption is determined by the producer of this product according to the legislation. During this term organoleptic, physical and chemical, medicobiological and other characteristics of goods shall answer the regulations and rules operating in Ukraine in case of observance of the corresponding storage conditions;

goods which need specific mode of storage, perishable goods which require in transit and storage of observance of special conditions (chilling, heating, aeration, care of goods or container and so forth) for prevention of impact on these goods of high or low air temperatures, and also other factors of external environment;

commodity transport and other shipping documents (further - shipping documents) - the documents going together with goods and the containing data on goods which move through customs border of Ukraine, including documents (the document of control of delivery, commodity transport delivery note, the bill of lading, the book of MDP, the invoice (pro forma bill), the shipping specification, the pack list and so forth) according to which their movement is performed.

1.3. Action of this provision extends to such types of goods as live animals, bodies and other anatomic materials of the person for requirements of transplantation, the goods having the limited term or specific mode of storage, radioactive materials, goods of the international technical and humanitarian assistance and also to other goods specified in part one of Article 79 of the Customs code of Ukraine (further - goods) which move through customs border of Ukraine and further take place in customs regimes of import, export (except goods which are exported under the external economic agreements (contracts) signed on compensatory to basis), temporary import (export).

2. Procedure for adoption by customs authority of the decision on customs clearance of goods in the simplified procedure

2.1. The decision on carrying out customs clearance of goods in the corresponding customs regime in the simplified procedure is made by the chief or the authorized officer of customs authority based on the statement of the company which possesses goods, in form which is determined by the State Customs Service of Ukraine.

The application is directed to customs authority (in duplicate) together with copies of the documents necessary for decision making, and is registered customs authority or its division in day of its receipt. The application shall be considered immediately.

2.2. Copies of such documents which confirm the data stated in it are enclosed to the application:

1) the external economic agreement (contract) or the decision of the Cabinet of Ministers of Ukraine, public authority or other documents (if, movement of goods is performed without the conclusion of the external economic contract (agreement) which according to the legislation of Ukraine determine the purpose and conditions of movement of goods through customs border of Ukraine;

2) accounting card of the subject of foreign economic activity;

3) shipping documents (in the presence);

4) permissions (references) and licenses of public authorities, the certificate on compliance (recognition), registration accounting card and so forth (in the cases established by the legislation of Ukraine) (in the presence);
