For the purpose of ensuring execution of the Presidential decree of the Republic of Uzbekistan of May 1, 2017 No. UP-5030 "About Measures for Radical Enhancement of Activities of the State Committee of the Republic of Uzbekistan for Architecture and Construction" and resolutions of the President of the Republic of Uzbekistan of May 1, 2017 No. PP-2936 "About measures for the organization of activities of the State committee of the Republic of Uzbekistan for architecture and construction" the Cabinet of Ministers decides:

1. Approve:

Regulations on the State committee of the Republic of Uzbekistan on architecture and construction according to appendix No. 1;

Regulations on Republican architectural town-planning council under the Cabinet of Ministers of the Republic of Uzbekistan according to appendix No. 2;

Regulations on territorial architectural town-planning council under Committee of the Republic of Karakalpakstan on architecture and construction, head departments on architecture and construction of areas and Tashkent according to appendix No. 3;

Regulations on the State inspection of architectural and construction supervision under the State committee of the Republic of Uzbekistan on architecture and construction according to appendix No. 4;

Regulations on Fund for support of educational institutions for the State committee of the Republic of Uzbekistan on architecture and construction according to appendix No. 5;

Standard regulations on Committee of the Republic of Karakalpakstan on architecture and construction, head departments on architecture and construction of areas and Tashkent according to appendix No. 6;

Standard regulations on district (city) departments (managements) of architecture and construction according to appendix No. 7;

Standard regulations on territorial administration of state examination, and also its standard structure according to appendices No. No. 8 and 8a;

Standard regulations on territorial inspection of the State architectural and construction supervision according to appendix No. 9;

Standard regulations on the territorial consulting center for the competitive biddings and pricing in construction, and also its standard structure according to appendices No. No. 10 and 10a.

2. To the state committee of the Republic of Uzbekistan on architecture and construction to approve Provisions in a month:

about Committee of the Republic of Karakalpakstan on architecture and construction, head departments on architecture and construction of areas and Tashkent;

about territorial administrations of state examination;

about inspections of the State architectural and construction supervision;

about the territorial consulting centers for the competitive biddings and pricing in construction.

3. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 11.

4. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan - the chairman of the board of JSC Uzbekiston temir yullari A. Zh. Ramatov and the chairman of the State committee of the Republic of Uzbekistan on architecture and construction B. I. Zakirov.

Regulations on the State committee of the Republic of Uzbekistan on architecture and construction

Chapter 1. General provisions

1. This Provision determines the main objectives, functions, the rights and organizational bases of activities of the State committee of the Republic of Uzbekistan on architecture and construction (further - Gosarkhitektstroy).

2. Gosarkhitektstroy is special representative state body in the field of town planning and is accountable to the Cabinet of Ministers of the Republic of Uzbekistan.

3. The central office of Gosarkhitektstroy, Committee of the Republic of Karakalpakstan on architecture and construction, head departments on architecture and construction of areas and Tashkent, the Republican center of standardization and certification in construction, the Center for economic reforming and pricing in capital construction, the Center of information support of town-planning activities, and also other organizations entering organizational structure of Gosarkhitektstroy (further - the organizations which are a part of the system of Gosarkhitektstroy), constitute single system of Gosarkhitektstroy.

4. Gosarkhitektstroy in the activities is guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, other acts of the legislation and this Provision.

5. Gosarkhitektstroy performs the activities in interaction with bodies of the public and economic board, law enforcement agencies, public authorities on places, non-state non-profit organizations, the foreign and international organizations, and also other organizations.

6. The decisions of Gosarkhitektstroy of normative and legal nature made within its competence are obligatory for execution of the public and economic board by bodies, state governing bodies on places, business entities, irrespective of pattern of ownership, and also citizens.

7. Gosarkhitektstroy is legal entity, has seal and forms with the image of the State Emblem of the Republic of Uzbekistan and with the name, separate balance, bank accounts both treasurer front and accounts in Treasury of the Ministry of Finance of the Republic of Uzbekistan.

Chapter 2. Main objectives and functions of Gosarkhitektstroy

8. The main objectives of Gosarkhitektstroy are:

implementation of system state architectural and construction supervision of strict compliance with law about town planning, town-planning regulations, rules, standards in case of complex building of settlements based on the master plans developed and approved in accordance with the established procedure, accomplishment project and building and construction works, production and application of construction materials and products, when carrying out test authority by customers and designer's service by the project organizations;

the organization of development and approval of the General scheme of resettlement in the territory of the republic, schemes of the layout of the territories of the Republic of Karakalpakstan, areas, areas, master plans of settlements and other town-planning documentation, conducting monitoring of implementation of town-planning documentation and state town-planning inventory;

preparation of offers on the main directions of state policy in the field of town planning and town-planning activities, participation in development of long-term and medium-term state programs of social and economic development of the territories, industry and regional programs;

carrying out single scientific and technical policy in the field of town planning, town-planning activities and technical researches for construction, implementation of highly effective and energy saving project decisions and construction materials, modern construction technologies and innovative projects;

implementation of coordination of project case and the construction activities, increase in efficiency of activities and expansion of regional network meeting the modern requirements of the design and survey organizations, the organization of development individual, the standard, repeatedly applied and pilot projects and project decisions, increase in role and responsibility of designer's service, conducting state examination town-planning, preproject and the design estimates;

implementation in construction production of the advanced technologies providing work performance improvement, reduction in cost of construction, rational use of resources, maintaining the Register of construction contract organizations;

deepening of processes of market transformations, universal implementation of mechanisms of competitive pricing, increase in role of corporate regulations and quotations, enhancement of the estimate regulatory base of designing and construction;

enhancement of system of public procurements in capital construction, development and conducting examination of tender (tender) documentation, control of observance of established procedure of the organization and carrying out the competitive biddings, conducting monitoring of execution of contractual commitments;

implementation of licensing of activities for development of architectural and town-planning documentation, conducting examination of the design estimates and separate types of construction activities;

providing on system basis of training of qualified personnel in the field of architecture, designing and construction, cardinal increase in level and quality of educational process in profile highest educational institutions and professional colleges of the republic, the organization on permanent basis of retraining and advanced training of designers and specialists of building sector.

9. Gosarkhitektstroy according to the tasks assigned to it performs the following functions:

a) in the field of implementation of system state architectural and construction supervision of strict compliance with law about town planning, town-planning regulations, rules, standards in case of complex building of settlements based on the master plans developed and approved in accordance with the established procedure, accomplishment project and building and construction works, production and application of construction materials and products, in the field of carrying out test authority by customers and designer's service by the project organizations:

exercises the state architectural and construction supervision of compliance with law about town planning, town-planning regulations, rules, standards in case of complex building of settlements based on master plans, accomplishment project and building and construction works, production and application of construction materials and products;

checks maintaining test authority of the customer and designer's service of the project organization;

exercises the state supervision of compliance with law about town planning, town-planning regulations, rules, compliance of quality of construction materials and products to state standards, high-quality accomplishment project and building and construction works;

issues permissions to implementation of building and construction works;

provides suspension of release, realization and application of construction materials and products in case of identification of violations of state standards and specifications, further production of building and construction works - in case of violations of normative requirements and the approved project decisions involving decrease in characteristics of durability and stability and also in case of threat of accidents of buildings and constructions, unauthorized construction of facilities. gives the written instructions obligatory for legal entities and physical persons, on elimination of the offenses revealed in the course of conducting checks;

in the cases and procedure established by the legislation participates in work of the commissions on acceptance for operation finished with construction of facilities;

considers disagreements between customers, developers of town-planning documentation and other organizations for town-planning documentation;

b) in the field of the organization of development and approval of the General scheme of resettlement in the territory of the republic, schemes of the layout of the territories of the Republic of Karakalpakstan, areas, areas (groups of areas), master plans of settlements and other town-planning documentation, conducting monitoring of implementation of town-planning documentation and the state town-planning inventory:

approves master plans of the cities, city settlements, except for master plans of the cities which approval is referred to competence of the Cabinet of Ministers of the Republic of Uzbekistan, and drafts of the detailed layout of the central parts of Tashkent, the regional centers and the cities having objects of cultural heritage;
