About rates for services of the airports and aeronautical services
Based on subitem 2.1 of Item 2 of the Presidential decree of the Republic of Belarus of February 25, 2011 No. 72 "About some questions of price regulation (rates) in the Republic of Belarus", Item 1 of the resolution of Council of Ministers of the Republic of Belarus of September 14, 2023 No. 598 "About the services relating the Ministry of anti-monopoly regulation and trade of the Republic of Belarus to spheres of natural monopolies, the prices (rates) for which are regulated by the Ministry of anti-monopoly regulation and trade", DECIDES:
1. Establish limiting maximum rates for services of the airports and aeronautical services according to appendix.
2. Approve the enclosed Instruction about procedure for establishment and application of rates for services of the airports and aeronautical services.
3. This resolution becomes effective after its official publication.

1. This Instruction determines procedure for establishment and application of rates for services of the airports and aeronautical services (further - services).
2. Action of this Instruction extends on all legal entities and the individual entrepreneurs rendering services in the territory of the Republic of Belarus (further - subjects of business activity).
3. Subjects of business activity establish rates for services which shall not exceed limiting maximum rates, stipulated in Item 1 resolutions, approved this Instruction, and apply them to settlings with the organizations performing activities in the field of aircraft, other owners, lessees and operators of air vehicles having the certificate (certificate) of the operator of the air vehicle in case of accomplishment of scheduled and unscheduled flights by them and also with other consumers of services.
Rates are established in appendix to the resolution which approved this Instruction, excluding tax on value added. The value added tax is levied according to the legislation.
4. Subjects of business activity have the right to provide discounts from the rates established by them.
In case of provision of discounts according to part one of this Item the coefficients provided by this Instruction are established to the rates applied by subjects of business activity reduced by the discount size.
5. For the purposes of this Instruction terms and determinations in the following values are applied:
the deported passenger – the foreign citizen or the stateless person which are subject to administrative expulsion out of limits of the Republic of Belarus according to the legislation;
the lease agreement, chartering (charter) of air vehicles – the agreement under which one party (freighter) shall provide to other party (freighter) for payment for accomplishment of one or several runs one or several air vehicles or part of the air vehicle for airborne transportations;
commercial loading of the air vehicle – loading which includes passengers, baggage, load and mail;
hardware of the air vehicle – the case, engines, constituents, nodes, aggregates, the equipment of the air vehicle;
dangerous goods – products or substances which in transit are by air capable to create considerable threat for health, safety of the person or property;
the transient – the passenger who according to the air transport agreement is transported further by the same flight by which it arrived in the intermediate airport (Item);
the passenger transfer – the passenger who according to the air transport agreement arrived to the airport (Item) of transfer one run also continues flight by other run of the same or other carrier;
carrier – the organization performing activities in the field of aircraft which issues the ticket the freight bill or other carriage document and performs or undertakes to perform airborne transportation according to these documents, and also provides or undertakes to provide the services connected with the same transportation;
the applied rate – the rate established according to Item 3 of this Instruction and (or) rate taking into account the discounts established according to item 4 of this Instruction;
