1. Approve the Procedure for implementation of the Agreement between Ukraine and the Republic of Tajikistan about the simplified procedure for change of nationality as citizens of Ukraine who constantly live in the Republic of Tajikistan, and citizens of the Republic of Tajikistan who constantly live in Ukraine which is applied.

3. To provide to department of legal providing (D.V.'s Gorbas) submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

4. We reserve control of execution of this order.

5. This order becomes effective from the date of its official publication.

I. General provisions

1.1. According to regulations of the Agreement between Ukraine and the Republic of Tajikistan on the simplified procedure for change of nationality by citizens of Ukraine who constantly live in the Republic of Tajikistan and citizens of the Republic of Tajikistan who constantly live in Ukraine, of the July 6, 2001 ratified by the Law of Ukraine of July 11, 2002 No. 115-IV (further - the Agreement), the citizens of the Republic of Tajikistan who are constantly living on legal causes in the territory of Ukraine have the right in the simplified procedure to acquire citizenship of Ukraine in the presence of one of the following conditions:

if the applicant or at least one of his parents (adoptive parents or adopters), the grandfather or the grandma were born or constantly on legal causes lived in the territory of Ukraine (till August 24, 1991);

if the applicant has at least one close relative who is constantly living on legal causes in the territory of Ukraine and which is citizen of Ukraine: the spouse (spouse), one of parents (adoptive parents or adopters), the child (including adopted or adopted), the sister, the brother, the grandfather or the grandmother, the grandson (granddaughter).

1.2. According to the Agreement the applicant submits to territorial subdivision of the Public migratory service of Ukraine (further - territorial subdivision) the statement for acquisition of citizenship of Ukraine and the simultaneous termination of citizenship of the Republic of Tajikistan.

1.3. Action of provisions of Item 1.1 of this Section does not extend to persons who:

committed crimes against humanity, performed genocide, or committed crimes against the state or serious crimes against the personality;

are condemned to imprisonment - before removal of criminal record;

are under examination or avoid punishment, or committed crime in the territory of Ukraine, the Republic of Tajikistan or the third state;

are in nationality of other states.

1.4. The documents confirming citizenship of the Republic of Tajikistan is the passport of the citizen of the Republic of Tajikistan, and before obtaining - the certificate of birth or other documents confirming nationality of this state.

1.5. Residence of person, permanent on legal causes, in Ukraine is confirmed by one of the following documents:

the permanent residence permit in the passport of the citizen of the Republic of Tajikistan or the international passport issued according to the Law of Ukraine "About immigration";

the passport of the citizen of the Republic of Tajikistan registered in the territory of Ukraine (in the presence in this passport of mark about provision of the exit visa to Ukraine on permanent residence).

1.6. Persons falling under operation of the Agreement are exempted from the payment of duty and all mandatory fees connected with acquisition or the termination of citizenship of Ukraine.

1.7. Question of acquisition or termination of citizenship of Ukraine other categories of persons which are not specified in the Agreement decide according to the Law of Ukraine "About citizenship of Ukraine" and Procedure for production according to statements and representations concerning citizenship of Ukraine and accomplishment of the made decisions, the approved Presidential decree of Ukraine of March 27, 2001 No. 215. II. Procedure for registration of acquisition of citizenship of Ukraine

2.1. For acquisition of citizenship of Ukraine persons specified in Item 1.1 of the Section I of this Procedure represent to territorial subdivision at the place of residence the following documents:

the statement questionnaire which form is given in appendix 1 to this Procedure;

three photos of 35х45 mm in size, including children aged from 7 years;

the copy of the document confirming residence of the applicant, permanent on legal causes, in Ukraine according to Item 1.5 of the Section I of this Procedure;
