About approval of Licensed conditions of implementation of economic activity on electricity distribution

According to articles 6 and 7 of the Law of Ukraine "About licensing of types of economic activity", article 17 of the Law of Ukraine "About the National commission performing state regulation in the field of power and utilities" the National commission performing state regulation in spheres of power and utilities decides:

1. Approve Licensed conditions of implementation of economic activity on distribution of electrical energy which are applied.

2. To licensees which perform economic activity on transfer of electrical energy local (local) power networks to bring the economic activity into accord with requirements of this resolution and to file to NKREKP documents and data determined by part three of article 15 of the Law of Ukraine "About licensing of types of economic activity" within six months from the date of entry into force of this resolution.

3. This resolution becomes effective from the date of, its publication following behind day in the official printing publication - the Pravitelstvenny Kuryer newspaper.

Licensed conditions of implementation of economic activity on electricity distribution

1. General provisions

1.1. These Licensed conditions establish the exhaustive list of the documents enclosed to the application for receipt of the license for implementation of economic activity on distribution of electrical energy (further - the licensed activities), and also determine the exhaustive list of the requirements, conditions and rules obligatory for accomplishment when implementing of the licensed activities.

1.2. The licensee shall fulfill requirements of these Licensed conditions, and the license applicant for its obtaining - to answer these Licensed conditions.

1.3. In these Licensed conditions terms are used in the following values:

policy tool of economic activity - the power generation facility intended for distribution of electrical energy, which is in property of the license applicant (licensee) and specified in the documents enclosed to the application for receipt of the license (taking into account the changes in documents given the licensee in the procedure established by these Licensed conditions);

the place of implementation of economic activity - the territory (or part of the territory) administrative and territorial unit where the power generation facilities intended for distribution of electrical energy, which are in property of the license applicant (licensee) and power networks of the consumers eating from networks of the license applicant (licensee) or from the power networks of other owners who do not have the license for distribution of electrical energy which the license applicant (licensee) approved with the central executive body realizing state policy in electrical power complex and noted in the documents enclosed to the application for receipt of the license attached to networks of the license applicant (licensee) are located (taking into account the changes in documents given the licensee in the procedure established by these Licensed conditions). If in the territory of administrative and territorial unit power generation facilities of other licensees on distribution of electrical energy are located, then the place of implementation of activities of each of these licensees is determined according to the territory of arrangement of the power generation facilities which are in property of the licensee and power networks of the consumers eating from networks of this licensee;

cross subsidizing - movement of the income from implementation of economic activity on distribution of electrical energy for financial support of other type of economic activity within one or several subjects of managing;

rate for distribution of electrical energy - the rate paid to the licensee for rendering services in distribution of electrical energy (transfer of electrical energy local (local) power networks);

purpose (use) of money - use of the means received from implementation of the licensed type of activity in the directions and amounts determined by structure of rate for distribution of electrical energy.

Other terms are used in the values given in the laws of Ukraine "About power industry", "About bases of functioning of the market of electrical energy of Ukraine", "About licensing of types of economic activity".

1.4. The license applicant who intends to perform economic activity on electricity distribution gives to the National commission performing state regulation in the field of power and utilities (further - NKREKP), the statement for receipt of the license in form according to appendix 1 to these Licensed conditions.

1.5. To the statement for receipt of the license by the license applicant documents according to the list which is exhaustive are provided:

1) the passport copy of the head of the license applicant (or the authorized representative) with mark of body of the State Tax Service about the notification on refusal on the religious beliefs of adoption of registration number of accounting card of the taxpayer (moves only physical persons entrepreneurs who on the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and notified on it relevant organ of the State Tax Service);

2) the copy of schemes and acts of differentiation of balance sheet accessory approved with other owners of power networks (licensees on production, transfer and distribution of electrical energy and subjects of managing which power networks are attached at the same time to two or more licensees);
