About approval of the Procedure for financial provision of requirements of national defense of the state, mobilization preparation, actions for mobilization and Armed Forces at the expense of charitable gifts of physical persons and legal entities

According to part seven of article 2 of the Law of Ukraine "About defense of Ukraine", "About mobilization preparation and mobilization" and article 9 of the Law of Ukraine "About the Armed Forces of Ukraine" the Cabinet of Ministers of Ukraine decides parts five of article 7 of the Law of Ukraine:

1. Approve the Procedure for financial provision of requirements of national defense of the state, mobilization preparation, actions for mobilization and Armed Forces at the expense of charitable gifts of physical persons and legal entities which is applied.

2. Declare invalid the resolution of the Cabinet of Ministers of Ukraine of July 2, 2014 No. 222 "About approval of the Procedure for financial provision of requirements of national defense of the state (Armed forces) at the expense of charitable gifts of physical persons and legal entities for ensuring combat, mobilization readiness, fighting capacity and functioning of Armed Forces" (The Official Bulletin of Ukraine, 2014, No. 54, the Art. 1449).

Procedure for financial provision of requirements of national defense of the state, mobilization preparation, actions for mobilization and Armed Forces at the expense of charitable gifts of physical persons and legal entities

1. This Procedure determines the mechanism of financial provision of requirements of national defense of the state, mobilization preparation, actions for mobilization and Armed Forces at the expense of charitable gifts of physical persons and legal entities (further - charitable gifts).

Action of this Procedure extends on:

The Ministry of Defence, military units, military educational institutions, organizations and the organizations of Armed Forces - regarding additional financing of the tasks determined for them by the legislation concerning ensuring defense of the state, mobilization, mobilization and combat readiness, fighting capacity and functioning of Armed Forces;

other military forming formed according to the laws, law enforcement agencies, the ministries, other central executive bodies, State special transservice, Gosspetssvyaz, the local state administrations (further - state bodies), village, settlement and city councils (further - local government bodies) - regarding additional financing of the tasks determined for them by the legislation by ensuring defense of the state, mobilization preparation and/or measures for mobilization.

2. For receipt of charitable gifts the Ministry of Defence, state bodies, local government bodies, military units, military educational institutions, organizations and the organizations of Armed Forces open in bodies of Treasury special registration accounts according to the Procedure for opening and closing of accounts in national currency in bodies of the Public treasurer service of Ukraine approved by the Ministry of Finance.

From physical persons and legal entities (residents and nonresidents) the Ministry of Defence, state bodies and local government bodies can attract charitable organizations by the conclusion of the agreement on cooperation to the organization of collection of charitable gifts.

The Ministry of Defence, state bodies, local government bodies, military units, military educational institutions, organizations and the organizations of Armed Forces perform collection of charitable gifts according to requirements of the Law of Ukraine "About charity and charitable organizations".

3. Information on account details for implementation of charitable gifts is placed the Ministry of Defence, state bodies, local government bodies, military units, military educational institutions, organizations and the organizations of Armed Forces on own official sites (in mass media) or is in writing reported to the physical persons and legal entities wishing to perform charitable gift according to their addresses.

4. Charitable gifts according to the estimates approved in the procedure established by the legislation go:

The Ministry of Defence, military units, military educational institutions, organizations and the organizations of Armed Forces - on accomplishment of the tasks and actions determined for them by the Laws of Ukraine "About defense of Ukraine", "About mobilization preparation and mobilization" and "About the Armed Forces of Ukraine";

state bodies and local government bodies - on accomplishment of the tasks and actions determined for them by the Laws of Ukraine "About defense of Ukraine" and "About mobilization preparation and mobilization".

In case of receipt of charitable gifts for accomplishment of target actions the Ministry of Defence, state bodies, local government bodies, military units, military educational institutions, organizations and the organizations of Armed Forces use them on accomplishment of such actions according to the estimates approved in the procedure established by the legislation.

The charitable organizations receiving charitable gifts into own accounts from physical persons and legal entities (residents and nonresidents) for agreement performance imprisoned with the Ministry of Defence and/or state bodies, local government bodies transfer them in ten-day time into special registration accounts of the Ministry of Defence and/or state bodies, local government bodies.

5. Distribution of charitable gifts which are enlisted into special registration accounts of the Ministry of Defence and/or state bodies, military units, military educational institutions, organizations and organizations of Armed Forces without specifying of specific purpose in the corresponding directions of use affirms their heads or persons authorized by them.

Distribution of such charitable gifts by local government bodies is performed by adoption of the relevant decision by them.

For ensuring implementation of public control over use of charitable gifts under the Ministry of Defence and state bodies consultative bodies which part representatives of public organizations are can be formed (in coordination). Quantitative and the staff of such bodies and regulations on them affirm the Ministry of Defence and state bodies.

Local government bodies with the specified purpose can also form the relevant standing or temporary bodies.
