RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

About measures for further streamlining of activities in the field of use of underground waters

(as amended on 30-12-2021)

In pursuance of the resolution of the President of the Republic of Uzbekistan of May 4, 2017 "About measures for streamlining of control and accounting of rational use of inventories of underground waters for 2017 - 2021" the Cabinet of Ministers decides No. PP-2954:

1. Approve and enact since July 1, 2017:

Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 14.08.2019 No. 672

Regulations on the state monitoring of underground waters according to appendix No. 2.

2. To provide to the state committee of the Republic of Uzbekistan on geology and mineral resources and the State committee of the Republic of Uzbekistan on ecology and environmental protection together with Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent, areas (cities) according to the procedure established by this resolution till December 31, 2018:

acceptance on accounting of the operational wells drilled without receipt of permission, but taking into account observance of technical requirements, with further registration in accordance with the established procedure permissions to special water use;

liquidation of the operational wells drilled without receipt of permission and in defiance of technical requirements with further entering into the Ministry of housing-and-municipal servicing of the Republic of Uzbekistan of offers on connection of the corresponding water users and water consumers to alternative sources of water.

3. Determine the State committee of the Republic of Uzbekistan on geology and mineral resources authorized body in implementation of hydrogeological inspection of single and group water intaking constructions irrespective of forms of their property, and also conducting control and accounting of rational use of underground waters in accordance with the established procedure.

4. Declare invalid the resolution of the Cabinet of Ministers of August 4, 2014 No. 214 "About approval of the Regulations on approval procedure on well-drilling on water" (the joint venture of the Republic of Uzbekistan, 2014, No. 8, the Art. 78).

5. Make changes and additions to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

6. To the ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

7. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan G. I. Ibragimov.

Regulations on the state monitoring of underground waters

Chapter 1. General provisions

1. This Provision determines the purpose, the main objectives, objects and procedure for conducting the state monitoring of underground waters in the territory of the Republic of Uzbekistan.

2. The state monitoring of underground waters (further - the state monitoring) is component of monitoring of subsoil and the surrounding environment.

3. Object of the state monitoring are underground waters, irrespective of their quality, purpose and nature of use.

4. The state monitoring represents system of regular observations of condition of underground waters, including mineral, thermal and industrial waters.

Data of the state monitoring are used for the state reports and official publications, information exchange at the interdepartmental and international levels in accordance with the established procedure, and also for designing and construction of facilities, maintaining the state water inventory and accounting of use and protection of underground waters.

5. Conducting the state monitoring is performed within Programs of monitoring of the surrounding environment of the Republic of Uzbekistan and annual state programs of development and reproduction of mineral resources of the republic.

Monitoring of underground waters depending on solvable tasks is conducted at the state and production levels.

Chapter 2. Purpose and main objectives of the state monitoring

6. Main objective of the state monitoring is timely identification of changes of high-quality and quantitative condition of underground waters, their assessment and the forecast, the prevention and development of recommendations about elimination of negative processes and their effects.

7. The main objectives of the state monitoring are:

organization and conducting regular observations of condition of underground waters;

collection, processing, storage and the analysis of the obtained information;

conducting the state accounting of use of underground waters;

determination of nature and extent of technogenic impact on resources and inventories of underground waters;

assessment of level of pollution and depletion of underground waters;

assessment of change of the hydrodynamic and hydrochemical mode of underground waters;

development of forecasts of change of condition of underground waters for the short and long-term periods;

providing state bodies and organizations with information on condition of underground waters.

8. The state monitoring is intended for assessment of condition of underground waters by qualitative and quantitative indices and the forecast of change, including the operated fields of underground waters, accounting of forecast resources and inventories of underground waters and their use, preparation of information for inclusion in the Section of underground waters of the state water inventory.

Chapter 3. Objects of the state monitoring

9. Objects of the state monitoring are subdivided on:

fresh and slabosolonovaty underground waters;

mineral, thermal and industrial underground waters;

hydrogeodeformation field of the earth.

10. The state monitoring of fresh and slabosolonovaty underground waters represents information and measuring system of observations of condition and change of the hydrodynamic and hydrochemical mode.
