According to Article 47 of the Budget code of the Kyrgyz Republic, article 614 of the Code of the Kyrgyz Republic about the administrative responsibility, articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve the Procedure for forming and use of the amounts of the administrative penalties collected for making of the administrative offenses fixed using the certified special control and measuring technical means working in automatic mode having functions photo and filmings, videos (further - system of photovideo fixing), according to appendix.

2. To the Ministry of Internal Affairs of the Kyrgyz Republic to bring the decisions into accord with this resolution.

3. To the Ministry of Finance of the Kyrgyz Republic:

- record cash receipts from payment of administrative penalties and to monthly carry out reconciliation on the specified means with the Ministry of Internal Affairs of the Kyrgyz Republic;

- taking into account actually arriving means from payment of administrative penalties in accordance with the established procedure to make changes to the republican budget of the Kyrgyz Republic for the corresponding period according to the budget legislation.

4. To impose control of execution of this resolution on department of defense, law and order and emergency situations of Government office of the Kyrgyz Republic.

5. This resolution becomes effective after ten days from the date of official publication.

Appendix

Procedure for forming and use of the amounts of the administrative penalties collected for making of the administrative offenses fixed using the certified special control and measuring technical means working in automatic mode having functions photo and filmings, videos

1. This Procedure is applied in case of collection of the amounts of administrative penalties for making of the administrative offenses encroaching on safety regulations of traffic and operation of the vehicles provided by Chapter 20 of the Code of the Kyrgyz Republic about the administrative responsibility, fixed using the certified special control and measuring technical means working in automatic mode having functions photo and filmings, videos (further - system of photovideo fixing).

2. Systems of photovideo fixing are acquired and established at the expense of means of the local or republican budget according to the minimum technical requirements established by the Ministry of Internal Affairs of the Kyrgyz Republic (further - the Ministry of Internal Affairs).

3. Local government bodies (further - OMSU) install systems of photovideo fixing in the administrative territory, connect to information system of the Ministry of Internal Affairs and provide their functioning.

4. Account of cash receipt from payment of administrative penalties is kept in automatic mode with use of information system of the Ministry of Internal Affairs. The reconciliation on the specified means is made monthly between the Central Treasury of the Ministry of Finance of the Kyrgyz Republic and the Ministry of Internal Affairs.

5. OMSU are provided with access in real time to information on the collected administrative penalties through information system of the Ministry of Internal Affairs.

6. The amounts of administrative penalties collected for making of the administrative offenses revealed using systems of photovideo fixing are in full enlisted in the income of the republican budget and go:

- 50 percent from actually arrived amounts - in the local budget OMSU at the expense of which the system of photovideo fixing, in the form of target transfers was acquired;

- 10 percent from actually arrived amounts - on financing of the Ministry of Internal Affairs.

7. The amounts of the administrative penalties collected for making of the administrative offenses revealed using systems of photovideo fixing, which did not enter in case of introduction of amendments to the law on the republican budget of the Kyrgyz Republic for the corresponding year of 100 percent are enlisted in the republican budget and are not subject to redistribution.

8. The amounts of administrative penalties collected for making of the administrative offenses revealed using systems of photovideo fixing are used by OMSU within creation of conditions for maintenance of functioning of systems of photovideo fixing and their development, including on:

1) acquisition of services of maintenance;

2) acquisition of systems of photovideo fixing;

3) acquisition of communication services;

4) expenses on running repair;

5) lease of property;

6) acquisition of transport services;

7) acquisition of other goods and services;

8) acquisition of objects and materials for the current economic purposes;

9) payment on utilities;

10) expenses on constructions;

11) maintenance costs of machines and equipment.

9. OMSU use means for improvement of road infrastructure in the administrative territory.

10. The amounts of administrative penalties collected for making of the administrative offenses revealed using systems of photovideo fixing are used by the Ministry of Internal Affairs within creation of conditions for maintenance of functioning of systems of photovideo fixing and their development, including on:

1) acquisition of communication services;

2) expenses on running repair of the equipment used by the staff of law-enforcement bodies;

3) acquisition of objects, materials and services for the current economic purposes;

4) maintenance costs of machines and equipment.
