About service by the ordinary and commanding structure of bodies and organizations of criminal executive system of the Kyrgyz Republic

This Law determines procedure and conditions of service by the ordinary and commanding structure of bodies and organizations of criminal executive system of the Kyrgyz Republic. Operation of this Law does not extend to the military personnel of Department on protection of correctional facilities and convoy of the convicts and persons taken into custody, except as specified, provided by this Law.
The service in bodies and organizations of criminal executive system is type of public service of the citizens of the Kyrgyz Republic performing professional activity on realization of functions, the rights and obligations of the bodies and organizations of criminal executive system which are a part of the system of law enforcement agencies of the Kyrgyz Republic.
1. For the purpose of technical supply of activities of bodies and organizations of criminal executive system the corresponding positions of civilian workers (workers and employees) are provided in their staff lists. The list of the specified positions is determined by the head of authorized state body in the sphere of execution of punishments.
2. Employment relationships of civilian structure of bodies and organizations of criminal executive system are regulated by the Labor code of the Kyrgyz Republic.
For faces of the certified structure of bodies and organizations of criminal executive system of the Kyrgyz Republic are established by the legislation of the Kyrgyz Republic and the following special ranks are given:
- ordinary internal service;
- lance sergeant of internal service;
- sergeant of internal service;
- staff sergeant of internal service;
- foreman of internal service;
- ensign of internal service;
- senior warrant officer of internal service;
- second lieutenant of internal service;
- lieutenant of internal service;
- senior lieutenant of internal service;
- captain of internal service;
- major of internal service;
- lieutenant colonel of internal service;
- colonel of internal service;
- major general of internal service.
The positions held by the staff of bodies and organizations of criminal executive system are subdivided into the following groups:
ordinary structure (ordinary internal service);
the younger commanding structure (the lance sergeant of internal service, the sergeant of internal service, the staff sergeant of internal service, the foreman of internal service, the ensign of internal service, the senior warrant officer of internal service);
the average commanding structure (the second lieutenant of internal service, the lieutenant of internal service, the senior lieutenant of internal service, the captain of internal service);
the senior commanding structure (the major of internal service, the lieutenant colonel of internal service, the colonel of internal service);
the highest commanding structure (the major general of internal service).
1. On service in bodies and organizations of criminal executive system of the Kyrgyz Republic the citizens of the Kyrgyz Republic who served active military or passed alternative (extra army) service, on the bases following from marital status, meeting for the business and personal qualities to requirements imposed to the staff of bodies and organizations of criminal executive system of the Kyrgyz Republic are accepted on voluntary basis including:
- to positions of the ordinary and younger commanding structure persons are accepted 30 years are not more senior; persons having working life at least 5 years in bodies and organizations of criminal executive system on civilian position - are not more senior than 35 years;
- to positions of average and the senior commanding structure persons are accepted 35 years are not more senior; persons having working life at least 5 years in bodies and organizations of criminal executive system on civilian position - are not more senior than 40 years.
At the same time requirements concerning passing of military or alternative (extra army) service do not extend to women. The list of positions which the citizens who passed alternative extra army service can replace affirms the Government of the Kyrgyz Republic.
2. Again accepted employees of the certified structure of bodies and organizations of criminal executive system have obligatory initial training in educational institution of criminal executive system of the Kyrgyz Republic.
Educational institutions of the Ministry of Internal Affairs of the Kyrgyz Republic can perform training of employees of criminal executive system of the Kyrgyz Republic.
3. Recruits are not subject to acceptance on service in bodies and organizations of criminal executive system of the Kyrgyz Republic. Training time in educational institutions of law enforcement agencies is set off as urgent active duty after assignment of the first special officer rank.
4. Positions of the ordinary and younger commanding structure of bodies and organizations of criminal executive system of the Kyrgyz Republic are completed with persons capable on the education level, personal and business qualities, the state of health to carry out the obligations assigned to them.
Persons from among the younger commanding structure of bodies and organizations of criminal executive system of the Kyrgyz Republic, the having average and higher education, can be appointed to positions of average and the senior commanding structure of bodies and organizations of criminal executive system of the Kyrgyz Republic aged 40 years are not more senior.
