This "Procedure" is developed according to provisions of the Customs code and other regulations of the Republic of Moldova, and also international agreements as which party the Republic of Moldova acts.

This provision of "Procedure" cannot limit engineering procedure of transportation of the electric power.

1. General provisions

1.1. For the purpose of application of this "Procedure" the following concepts are used:

- the act for customs control (ATK) - the composite balance sheet of the electric power containing information on goods (electric power) necessary for customs clearance, customs statistics and for application in accordance with the established procedure in case of execution of the cargo customs declaration (CCD);

- carrier - the legal entity who is actually moving the electric power through border of the Republic of Moldova;

- physical control - the complex of actions directed to establishment of exact amounts of electric power, the Republic of Moldova moved through customs border with use of these measuring devices;

- electric power overflows between electric utility systems of the states - quantity of the electric power moved on power lines in controlled sections;

- transit of the electric power - and) transfer through customs area of the Republic of Moldova, on its power networks, the electric power made in the territory of other state and intended for the territory of the third state;

- business entity - the legal entity performing one or several types of activity connected with production, transfer or electricity distribution according to the current legislation of the Republic of Moldova;

- technological movement of the electric power - movement of the electric power through customs border of the Republic of Moldova between power supply systems of the countries (or their parts) during their parallel work with the purpose of support of parameters of work of these power supply systems (or their parts) which is subject to compensation (return) further with certain frequency.

1.2. The electric power moved through customs border of the Republic of Moldova on electric power transmission lines is subject to customs control and customs clearance according to the current legislation.

1.3. Transportation of the electric power on electric power transmission lines through customs border of the Republic of Moldova without registration of ATK is not allowed, and registration of such transportation is made in the corresponding customs regime.

1.4. The economic agent performing import export or transit of the electric power represents GTD to the customs authorities determined by Customs department of the Republic of Moldova.

1.5. Customs control of commodity export, in the settlement account for the imported electric power, the Chisinau customs performs (or other customs determined by Customs department with accumulation of all information in one customs).

2. Customs control

2.1. The electric power moved through customs border of the Republic of Moldova is under customs control from the moment of passing through customs border and to its customs clearance in the corresponding customs regime.

2.2. The customs control zone of amounts of electric power moved through customs border of the Republic of Moldova are determined by Customs department in the territories of energy objects (the stations, substations).

2.3. Customs control of amounts of electric power, the Republic of Moldova moved through customs border on electric power transmission lines, is performed by the employee of customs by means of reconciliation of documents (ATK) with meter readings.

2.4. For the purpose of efficiency of implementation of customs control in Items of overflow of the electric power counters of receipt of the electric power because of customs area of the Republic of Moldova, electric power exit counters from customs area of the Republic of Moldova and counters of receipt of the electric power to business entities - electric power distributors are sealed up by customs seals of the Republic of Moldova.

2.5. The customs authority exercising physical control of amounts of electric power of the Republic of Moldova moved through customs border on electric power transmission lines, monthly, no later than the 5th following month under report informs the relevant centralized customs authority on results of the carried-out control.

2.6. Carrying out any manipulations (replacement, checking) with electric power meters out of customs control is forbidden.

3. Customs clearance

3.1. For customs clearance of the electric power moved through customs border of the Republic of Moldova on electric power transmission lines, economic agents submit to customs authority necessary documents and other additional information according to the existing standard rates, including the goods specified in subitems 13 and 14 of the Regulations on lock of the declaring of customs value imported on the territory of the Republic of Moldova approved by the Order of the Government N600 of 14.05.2002.

3.2. The electric power delivered under one agreement during estimated time (month, quarter) is declared as one batch.

3.3. The customs clearance of the electric power is performed based on provided to ATK and GTD, drawn up according to existing rules.

3.4. Before electrical supply, a month before its planned import, export or transit, the relevant customs authority is notified by business entity on such quantity of the electric power which will be delivered through customs border of the Republic of Moldova, by means of submission of short data in the established form (KS), together with documents for expected transactions (the contract in foreign trade, in writing drawn up requests and offers), without registration of GTD.

3.5. Movement of the electric power through customs border of the Republic of Moldova, after representation of KS, can be performed only in the terms specified in specific KS.

3.6. Declaring of the electric power moved between electric utility systems of the Republic of Moldova and other states is made by means of giving of periodic GTD on actually moved quantity of the electric power for the settlement period established among themselves by the above-stated electric utility systems under approval of the national customs departments.
