of July 6, 2017 No. 424

About approval of the State program of development of intellectual property in the Kyrgyz Republic for 2017-2021

(as amended of the Order of the Government of the Kyrgyz Republic of 30.05.2019 No. 252)

For the purpose of creation of conditions for functioning of the market of intellectual property by 2021, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve the State program of development of intellectual property in the Kyrgyz Republic for 2017-2021 (further - the State program) according to appendix.

2. To the ministries, administrative departments, public institutions and the organizations, local government bodies (in coordination), responsible for implementation of the State program to provide its execution and quarterly no later than the 5th following the accounting period, to provide the relevant information in Public service of intellectual property and innovations under the Government of the Kyrgyz Republic.

3. To public service of intellectual property and innovations under the Government of the Kyrgyz Republic:

- take the necessary measures following from this resolution;

- following the results of every half-year no later than the 25th following the accounting period to submit the report on the course of implementation of the State program in Government office of the Kyrgyz Republic.

4. To impose control of execution of this resolution on department of education, culture and sport of Government office of the Kyrgyz Republic.

5. This resolution becomes effective after fifteen days from the date of official publication.

The state program of development of intellectual property in the Kyrgyz Republic for 2017-2021

1. General situation

At the present stage of development role and the place of the country in system of the interstate relations, competitiveness of economy and homeland security in many respects depend on the level of innovative development of the country. Therefore forming in the Kyrgyz Republic of innovative system, the market of intellectual property (further - IS) is one of national interests of the country.

The leading countries of the world passed to "economy of knowledge" at the heart of which innovations, the latest technologies, development of IS are pledged. In recent years in developed countries of the world to 70% of surplus of GDP it is created by means of creation and implementation of new technologies and the knowledge-intensive productions.

Economic capacity of the Kyrgyz Republic determines some financial and technological dependence of the republic from more developed countries. Important trading and investment partners of the Kyrgyz Republic are Russia, China, the European Union, the United States of America, Turkey, Japan, Germany, Switzerland, Great Britain and other countries.

In cooperation with them the Kyrgyz Republic makes efforts on further reforming of economic system and implementation of the market relations. In 1998, having entered the World Trade Organization, the Kyrgyz Republic harmonized the national legal system in the sphere of foreign trade according to international standards, including the regulations concerning IS sphere within the Agreement on trade aspects of the rights of IS.

In 2015 GDP of the Kyrgyz Republic was created mainly at the expense of agricultural industry (14%), processing industry (% 15,3), construction (% 8,3), the sphere of trade and services (% 50,3).

Such structure of economy is poorly adapted for external environment and depends on permanent capital inflow.

The level of development of economy of the Kyrgyz Republic, and also certain dependence on the donor countries and the international financial institutions do not allow the republic to resist to world crisis fully independently.

Entry into the Eurasian Economic Union requires reforming of separate industries of economy, especially the potential of industrial and agricultural production. Large-scale updating of technological base, increase in susceptibility of business to innovations, increase in direct investments of innovative orientation, development of human capital, support and stimulation of innovative activities is necessary.

2. Analysis of the current situation

In the National sustainability strategy of the Kyrgyz Republic for 2013-2017 approved by the Presidential decree of the Kyrgyz Republic of January 21, 2013 No. 11, one of the priority directions improvement of competitiveness of the country on the basis of implementation of innovations is determined.

In the Program of the Government of the Kyrgyz Republic "Trust and unity" approved by the resolution of Jogorku Kenesh of the Kyrgyz Republic of November 9, 2016 No. 1053-VI it is noted: "Upgrade of economy requires modernization and implementation of modern technologies in the perspective directions of economy. The economy of the Kyrgyz Republic is open for new technologies and innovations which shall be stimulated with fiscal, administrative and legislative arrangements".

Despite political support of the country leaders of rate on development of innovative activities and IS, limitation of financial resources does not give the chance to fully start this process. Institutes of civil society and entrepreneurial circles are insufficiently interested in distribution of the ideas of IS and do not represent the opportunities opening for their development.

The international rating of "Doing business" reflects circle condition for business and is one of reference points for improvement of results of promotion in this direction. According to this rating in 2016 the Kyrgyz Republic rose by 35 line items and is in the 67th place from 189 countries of the world.

The index of global competitiveness estimates country capability effectively to use the available resources. According to this rating in 2015 the Kyrgyz Republic considerably improved the line items, having risen by 13 line items, having taken the 108th place, and in 2016 took the 111th place among 138 countries of the world.

In rating "Index of economic freedom" the country is in the 96th place among 186 countries of the world.

All this demonstrates that in the country favorable conditions for investing activities, including in the innovative sphere are consistently created.

Despite the achieved results, it is necessary to strengthen further activities for increase in efficiency of the direction of investments on attraction of innovative technologies and development of legal relationship in IS sphere.

The Kyrgyz Republic has high potential for development of hydropower that allows to attract and create the new power technologies based on IS, especially for development of network of hydroelectric power stations of the Kyrgyz Republic.

In the territory of the republic there are more than two thousand mineral deposits. Need of implementation of new technologies in case of development of such fields can give impetus for activization of inventive and innovative activities in this industry.

The Kyrgyz Republic has favorable climatic conditions for development of agricultural potential. Creation and implementation of new objects of IS for development of seed farming, agriculture, crop production and conversion of agricultural products will allow to increase production volumes of competitive products in the internal and external markets.

According to the Index of human development which determines the main social indicators of wellbeing of the population the Kyrgyz Republic in 2015 took the 120th place among 188 countries. In case of determination of this index the large role is played by the level of the income of the population.

Now in the sphere of IS the following tendencies are observed:

- low level of income of the population which promotes wide circulation of counterfeit products, including life-endangering and to health of the person. This tendency also has influence on image of the Kyrgyz Republic as constitutional state;

- violation of the rights of authors and inventors affects their welfare that reduces their creative activity;

- depreciation of prestige of workers of the inventive and creative sphere led to loss of interest at youth in such professions.

Thus, to the forefront there are questions connected with observance of the rights of authors and inventors, forming of the atmosphere of intolerance to counterfeit products and also increase in the importance of creative professions.

In world practice information and communication technologies, including the Internet, promote creation of new goods and services, opening and inventions.

On the Index of development of information and communication technologies since 2011 the Kyrgyz Republic improved the line items on 15 Items and took the 97th place from 166 countries of the world.

Dynamics of development of information and communication technologies in the Kyrgyz Republic positively influences IS sphere, giving opportunity of receipt of access to world information databases. Thus, technical progress accelerates and the procedure of the international exchange of technical innovations becomes simpler.

The countries which for a short time achieved success in the development could achieve it due to large-scale borrowing of technologies in case of gradual building-up of own innovative potential. Such countries as Japan, the Republic of Korea, Hong Kong and Singapore, pursued borrowing policy since 1950 and in 20-30 years reached the level of developed countries.

Practice of borrowing of technologies in the Kyrgyz Republic did not gain broad development. So, for the period 2012-2016 in the country any license agreement on technology transfer is not registered.

On the basis of the carried-out SWOT analysis the following results are revealed.
