About approval of the Procedure for access for the state registrars of the rights to real estate and uses to data of the State land cadastre

According to part two of article 30 of the Law of Ukraine "About the State land cadastre", "About state registration of the rights to real estate and their encumbrances" the Cabinet of Ministers of Ukraine decides parts three of Article 32 and part one of article 33 of the Law of Ukraine:

1. Ceased to be valid according to the Resolution of the Cabinet of Ministers of Ukraine of 09.10.2020 No. 948

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

4. This resolution becomes effective from the date of its publication and is applied since October 1, 2017.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. According to the procedure of maintaining the State land cadastre, No. 1051 approved by the resolution of the Cabinet of Ministers of Ukraine of October 17, 2012 (The Official Bulletin of Ukraine, 2012, No. 89, Art. 3598; 2013, No. 80, Art. 2975; 2014, No. 97, Art. 2786; 2015, No. 46, Art. 1472, No. 54, Art. 1742, No. 79, Art. 2650; 2016, No. 2, Art. 102, No. 25, Art. 992, No. 71, Art. 2386; 2017, No. 9, Art. 280, No. 22, Art. 615, No. 51, Art. 1569):

The subitem 13 of Item 6 to exclude 1);

Item 113 to state 2) in the following edition:

"113. The state cadastral registrar in day of receipt of information on the registered corporeal rights to real estate by direct access to the State register of the corporeal rights to real estate enters data on owners, users of the parcel of land according to data of the specified Register in the Land book in electronic (digital) and paper form.";

"2) if within one year from the date of implementation of state registration of the parcel of land the corporeal right to it is not registered because of the applicant - based on information from the State register of the rights to real estate obtained by way of direct access to the specified Register.";

1) according to the procedure of state registration of the rights to real estate and their encumbrances, approved by the specified resolution:

to add Item 12 after the paragraph of the fourth with the new paragraph of the following content:

"Access to data of the State land cadastre is provided by means of software of maintaining the State register of the rights by search and obtaining by the state registrar in real time of data on the parcel of land, including the information about the owners, users of the parcel of land postponed from the state register of the lands containing in the State land cadastre.".

The technical administrator of the State register of the rights in real time reports to the State land cadastre of the data on the registered corporeal rights to the parcel of land by the criteria specified in search query for access to them for the state cadastral registrar.
