About provision of pensions of separate categories of citizens

For the purpose of increase in level of social protection of separate categories of citizens:

1. Determine that:

1.1. the work retirement pension is appointed in the presence of length of service with payment of compulsory insurance premiums in the budget of state non-budgetary fund of social protection of the population of the Republic of Belarus (further - insurance years of service) at least 10 years:

to the citizens having the length of service provided in article 51 of the Law of the Republic of Belarus of April 17, 1992 "About provision of pensions" (further - the Law), at least 40 years at men and 35 years at women;

to the citizens who were passing military service (service in paramilitary organizations) and having the length of service provided in article 51 of the Law, at least 25 years at men and 20 years at women including at least 10 calendar years of military service (services in paramilitary organizations) *.

The right to work retirement pension according to part one of this subitem is granted to the citizens who reached generally established retirement age, in the absence of the required insurance years of service established in the paragraph the second part one of article 5 of the Law, and not having pension entitlements according to the Law of the Republic of Belarus of December 17, 1992 "About provision of pensions of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee of the Republic of Belarus, the State committee of judicial examinations of the Republic of Belarus, bodies and divisions on emergency situations and bodies of financial investigations";

* For the purposes of the paragraph of third of part one of this subitem the military service (service in paramilitary organizations) is understood as the periods of military service (service in paramilitary organizations) specified in the Item "and" of part two of article 51 of the Law, except for the periods of military service (service in paramilitary organizations) falling on the stay period in social child care leave.

1.2. the periods of care of the disabled person of the I group or the handicapped child aged up to 18 years, and also for aged, reached 80-year age, needing according to the conclusion of medico-rehabilitation commission of experts or the state organization of health care permanent care, are set off in length of service before achievement by persons performing leaving, the age granting the right to social pension (men - 65 years, women - 60 years), in case of observance of other conditions provided in the Item "d" of part two of article 51 of the Law.

2. Financing of the expenses on pension payment appointed using the regulations containing in subitem 1.1 of Item 1 of this Decree in the part which is not caused by the insurance years of service which are available for the pensioner is made at the expense of means of the republican budget.

Financing of other expenses connected with implementation of this Decree is performed by budget funds of state non-budgetary fund of social protection of the population of the Republic of Belarus.

3. Recognize invalid:

The presidential decree of the Republic of Belarus of December 8, 2014 No. 570 "About enhancement of provision of pensions";

Item 1 and the paragraph third Item 3 of the Presidential decree of the Republic of Belarus of December 31, 2015 No. 534 "About questions of social security";

subitems 1.1 and 1.2 of Item 1 of the Presidential decree of the Republic of Belarus of April 11, 2016 No. 137 "About enhancement of provision of pensions".

4. To Council of Ministers of the Republic of Belarus:

in three-months time to provide reduction of acts of the legislation in compliance with this Decree;

take other measures for implementation of this Decree.

5. This Decree becomes effective in the following procedure:

Items 1 and 2 - from the first following after month of official publication of this Decree;

other provisions of this Decree - after its official publication.
