About approval of criteria by which the risk degree from implementation of economic activity in the sphere of seed farming is estimated and frequency of implementation of planned actions of the state supervision (control) by Public service for safety issues of foodstuff and consumer protection is determined

According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the sphere of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity in the sphere of seed farming is estimated and frequency of implementation of planned actions of the state supervision (control) by Public service for safety issues of foodstuff and consumer protection which are applied is determined.

2. Appendix 3 to the resolution of the Cabinet of Ministers of Ukraine of March 6, 2013 "About approval of criteria by which the risk degree from implementation of economic activity is estimated and is determined No. 191 frequency of implementation of agricultural industry of planned actions by the State inspectorate of the state supervision (control)" (2013, No. 24, the Art. 811) to exclude the Official Bulletin of Ukraine.

Criteria by which the risk degree from implementation of economic activity in the sphere of seed farming is estimated and frequency of implementation of planned actions of the state supervision (control) by Public service for safety issues of foodstuff and consumer protection is determined

1. Criteria by which the risk degree from implementation of economic activity in the sphere of seed farming is estimated are:

observance of requirements of the legislation in the sphere of seed farming;

production volume of seeds and landing material during the certain period (it is determined for seeds - by weight, for potatoes - by weight, for landing material - by the number of pieces);

sales amount of seeds and landing material during the certain period (it is determined for seeds - by weight, for potatoes - by weight, for landing material - by the number of pieces).

2. According to the established criteria subjects of managing treat one of three risk degrees - high, average and insignificant.

3. Subjects which correspond to the following criteria concern to subjects of managing with high risk:

Constitutes 1) within the year previous planned, production volume and/or realization of seeds (on all range of cultures):

for melkosemyanny cultures - 0,2 of ton of seeds and more;

for seed potatoes - 100 tons and more;

for other cultures - 500 tons of seeds and more;

2) within the year previous planned, production volume and/or realization of landing material (on all range of cultures) at the subject of managing is made by 10 thousand pieces and more;

3) when implementing within the last three years previous planned of actions of the state supervision (control) at the subject of managing violations of requirements of the legislation in the sphere of seed farming by results of at least two last actions of the state supervision (control) are revealed;

4) within the year previous planned the subject of managing received confirmation of the central executive body realizing state policy in the sphere of the state supervision (control) in the sphere of seed farming on import to the territory of Ukraine of samples of seeds and landing material of the plant varieties which are not included in the Register of plant varieties of Ukraine and/or the List of types of OECD for carrying out selection, research works and exhibiting.

5) within the year previous planned the subject of managing performed import to the territory of Ukraine of the seeds and landing material of grade which are not entered in the Register of plant varieties of Ukraine, but brought in the list of plant varieties of OECD, those agricultural plants to schemes of high-quality certification to which Ukraine, for the purposes of reproduction and the subsequent export out of limits of Ukraine joined.

4. With average risk degree concern subjects at which to subjects of managing:

Constitutes 1) within the year previous planned, production volume and/or realization of seeds (on all range of cultures):

for melkosemyanny cultures - from 0,1 of ton of seeds, but less 0,2 of ton of seeds;

for seed potatoes - from 30 tons of seeds, but less than 100 tons;

for other cultures - from 5 tons of seeds, but less than 500 tons of seeds;

Constituted 2) within the year previous planned, production volume and/or realization of landing material (on all range of cultures) from 5 thousand pieces and more, but less than 10 thousand pieces.

5. The subjects which are not carried to subjects of managing with high and average risk degree concern to subjects of managing with insignificant risk degree.

6. Planned actions of the state supervision (control) of activities of subjects of managing are performed with the following frequency:

with high risk - is not more often than once in two years;

with average risk degree - is not more often than once in three years;

with insignificant risk degree - is not more often than once in five years.

7. If within the last three years previous planned, but at least during the last two actions of the state supervision (control) the facts of violation of requirements of the legislation in the sphere of seed farming are not elicited, following planned action of the state supervision (control) concerning such subject of managing it is performed not earlier than through the period of time established for the corresponding risk degree, increased in time 1,5.

8. If the subject of managing can be carried at the same time to two or more risk degrees, such subject belongs to more high risk from among to what it can be carried.
