About approval of standards of the state services in the sphere of sanitary and epidemiologic wellbeing of the population

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve standards of the state services:

1) "State registration or re-registration of products of baby food, food and dietary supplements to food, genetically modified objects, dyes, means of disinfection, disinsection and deratization, materials and products contacting to water and food, chemicals, the separate types of products and substances making harmful effects on health of the person" according to appendix 1 to this order;

2) "Issue of the sanitary and epidemiologic conclusion about compliance (discrepancy) of object of the high epidemic importance to regulatory legal acts in the sphere of sanitary and epidemiologic wellbeing of the population and to hygienic standard rates" according to appendix 2 to this order;

3) "Assignment of accounting number to object of production (production) of food products" according to appendix 3 to this order;

4) "Issue of the sanitary and epidemiologic conclusion on drafts of the regulating documentation on maximum permissible emissions and maximum permissible dumpings of hazardous substances and physical factors in the environment, zones of sanitary protection and sanitary protection zones, on raw materials and products" according to appendix 4 to this order.

5) "Issue of the work permit with microorganisms of the I-IV group of pathogenicity and helminths" according to appendix 5 to this order;

6) "Issue of the sanitary and epidemiologic conclusion about coordination of expiration dates and storage conditions of food products" according to appendix 6 to this order;

7) "Issue of the certificate on assignment of qualification category for specialists in the sphere of sanitary and epidemiologic wellbeing of the population" according to appendix 7 to this order.

2. Recognize invalid some orders of the Minister of national economy of the Republic of Kazakhstan according to appendix 8 to this order.

3. To provide to committee of protection of public health of the Ministry of Health of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type in the state and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Health of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Health of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) of this Item.

4. To impose control of execution of this order on the vice-Minister of Health of the Republic of Kazakhstan Tsoi A. V...

5. This order becomes effective after ten calendar days after day of its first official publication.

Appendix 1

Standard of the state service "State Registration or Re-registration of Products of Baby Food, Food and Dietary Supplements to Food, Genetically Modified Objects, Dyes, Means of Disinfection, Disinsection and Deratization, Materials and Products Contacting to Water and Food, Chemicals, the Separate Types of Products and Substances Making Harmful Effects on Health of the Person"

Chapter 1. General provisions

1. The state service "State Registration or Re-registration of Products of Baby Food, Food and Dietary Supplements to Food, Genetically Modified Objects, Dyes, Means of Disinfection, Disinsection and Deratization, Materials and Products Contacting to Water and Food, Chemicals, the Separate Types of Products and Substances Making Harmful Effects on Health of the Person" (further – the state service).

2. The standard of the state service is developed by the Ministry of Health of the Republic of Kazakhstan (further – the Ministry).

3. The state service appears Committee of protection of public health of the Ministry (further – the service provider)

Documents acceptance for registration is performed through:

1) service provider;

2) web portal of "the electronic government": www.egov.kz (further – the portal);

for re-registration – through office of the service provider.

Issue of result of rendering the state service is performed through office of the service provider.

Chapter 2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of delivery of document package to the service provider, and also through the portal – 30 (thirty) calendar days;

2) the most allowed time of expectation for delivery of document package of-15 (fifteen) minutes;

3) the most allowed time of servicing of uslugopoluchatel – 20 (twenty) minutes.

5. Form of rendering the state service: electronic (partially automated) and paper.

6. Result of rendering the state service: the certificate on state registration according to appendix 1 to this standard of the state service, or the motivated answer about refusal in rendering the state service in the bases, stipulated in Item 10 these standards of the state service.

Form of provision of result of rendering the state service: electronic and paper.

In case of the request of uslugopoluchatel for result of rendering the state service on paper the result of rendering the state service is unpacked and certified by seal and the authorized signature of the service provider.

In case of the address of uslugopoluchatel through the portal the notification on result of the state service goes to "private office" in electronic form, certified by the digital signature (further – the EDS) the authorized person of the service provider.

7. The state service is rendered to physical persons and legal entities (further – uslugopoluchatel) on free basis.

8. Working schedule:

1) service provider: Monday through Friday inclusive, from 9:00 till 18:30 o'clock, with lunch break from 13:00 till 14:30 o'clock, except days off and holidays, according to the labor law of the Republic of Kazakhstan.

Reception of applications and issue of results of rendering the state service is performed from 9:00 to 17:30 o'clock with lunch break from 13:00 to 14:30 o'clock.

2) portal: round the clock (except for technical breaks in connection with carrying out repair work). In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays, according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering service is performed the next working afternoon.

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel (or his representative by proxy):

the statement in form according to appendix 2 to this standard of the state service;

for products made on customs area of the Eurasian Economic Union (further – EEU):

copies of documents according to which products are made (the standard the standard of the organization, specification), (one of the listed documents is provided), the technological instruction, compounding certified by the manufacturer (producer);

the written notice of the manufacturer (producer) that products made by it meet the requirements of documents according to which it is made. As the notification are accepted: copies of the quality certificate, the material safety data sheet (quality), certificates of quality certified by the manufacturer (producer) or the letter of the manufacturer (one of the listed documents is provided);

the document of the manufacturer (producer) on application (operation, use) of products (the instruction, management, the recommendation) (one of the listed documents) or its copy certified by the applicant;

the copy of labels (packaging) and their prototypes on products certified by the applicant;

the sampling report (tests) issued by laboratories (centers) accredited (certified) in national accreditation systems (certification) and the certification bodies entered in the Unified Register and test laboratories (centers) of EEU;

the protocol of researches (testing), issued by laboratories (centers), accredited (certified) in national accreditation systems (certification) and the certification bodies entered in the Unified Register and test laboratories (centers) of EEU on products, the scientific report, the expert opinion;

in case of use by the manufacturer as a part of perfumery and cosmetic products of nanomaterials, it is necessary to provide data on nanomaterial, including its chemical name, the size of particles, and also physical and chemical properties;

for products made out of customs area of EEU:

copies of documents according to which products are made (the international standard or the standard of foreign state, the technological instruction, compounding), certified by the manufacturer (producer);

the document of the manufacturer (producer) on application (operation, use) of products (the instruction, management, the recommendation) (one of the listed documents is provided) or its copy certified by the applicant;
