About approval of the Regulations on procedure for forming of the unified systematized register of functions of state bodies of the executive authority of the Kyrgyz Republic

For the purpose of carrying out systematization of functions of state bodies of the executive authority, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic DECIDES:

1. Approve Regulations on procedure for forming of the unified systematized register of functions of state bodies of the executive authority of the Kyrgyz Republic according to appendix.

2. To state bodies of the executive authority of the Kyrgyz Republic (further - state bodies):

- to carry out primary inventory count of functions of state bodies to three-months time;

- in a month after carrying out primary inventory count to create departmental registers of functions of state bodies;

- provide departmental registers of functions of state bodies to authorized state body on maintaining the unified systematized register of functions.

3. Determine that action of the paragraph of the fourth Item 2 of this resolution does not extend to the state bodies knowing questions of defense, protection of frontier, homeland security and law and order.

4. Determine the Ministry of Economics of the Kyrgyz Republic authorized state body by maintaining the unified systematized register of functions.

5. To authorized state body on maintaining the unified systematized register of functions:

- organize examination of the introduced departmental registers of functions of state bodies;

- after conducting examination of departmental registers of functions of state bodies to create the draft of the unified systematized register of functions of state bodies and to bring in Government office of the Kyrgyz Republic;

- render methodical and advisory assistance to state bodies in carrying out inventory count of functions and application of the above-stated Provision.

6. To impose control of execution of this resolution on department of public administration and personnel work and department of defense, law and order and emergency situations of Government office of the Kyrgyz Republic.

7. This resolution becomes effective after fifteen days from the date of official publication.

Regulations on procedure for forming of the unified systematized register of functions of state bodies of the executive authority of the Kyrgyz Republic

1. General provisions

1. The regulations on procedure for forming of the unified systematized register of functions of state bodies of the executive authority (further - the Provision) establish main objectives and the principles, procedure for forming and maintaining the list of the management functions which are carried out by state bodies of the executive authority (further - state bodies).

2. In this Provision the following concepts and terms are used:

1) function of state body - the regular activities of state body determined by regulatory legal acts of the Kyrgyz Republic by implementation of the tasks by means of the allocated powers of authority and which came in the procedure established by the law into force of international treaties which participant is the Kyrgyz Republic;

2) the unified systematized register of functions of state bodies - the systematized list of functions of state bodies classified by types of functions of public administration;

3) regulations of function of state body - the systematized list of requirements and conditions on accomplishment of the functions of state body establishing compulsory procedures of certain operations procedure on execution of functions in state body;

4) typification of functions of state body - systematization of functions by their separation into groups on the established signs or criteria on the basis of the communications existing between them and/or complementary communications.

3. The unified systematized register of functions of state bodies (further - the unified register) represents the single database containing information on functions of state bodies of the executive authority in paper and electronic formats which powers on execution are fixed in regulatory legal acts of the Kyrgyz Republic and international treaties which came in the procedure established by the law into force which participant is the Kyrgyz Republic.

4. Forming and maintaining the unified register is performed for the purpose of:

1) creations of system of accounting of functions of state bodies;

2) optimizations of distribution of functions in system of state bodies;

3) optimizations of functions and structure of state bodies;

4) developments of regulations of functions of state bodies.

5. Forming and maintaining the unified register is performed according to the following principles:

1) unity of requirements to determination and inclusion of functions in the unified register;

2) completeness and normative justification of the functions included in the unified register;

3) normative justification of all changes entered in the unified register;

4) openness and availability of the unified register to all interested persons;

5) regular updating of data on the functions containing in the unified register.

6. Forming of the unified register includes the following stages:

1) inventory count and preparation of departmental registers of functions by state bodies;

2) consideration by authorized state body on maintaining the unified systematized register of functions (further - authorized body) departmental registers of functions, adoption of the conclusions and preparation, in case of need, offers and notes;

3) forming of the draft of the unified register on the basis of departmental registers of functions;

4) approval of the unified register decision of the Government of the Kyrgyz Republic;

5) maintaining the unified register, implementation of monitoring of changes in regulatory legal acts, modification and amendments in the unified register.

7. Maintaining the unified register is assigned to authorized body.

8. Action of this provision:

1) does not extend to functions of provision of the state services included in the Unified register (list) of the state services approved by the order of the Government of the Kyrgyz Republic "About approval of the Unified register (list) of the state services rendered by state bodies, their structural divisions and subordinated organizations" of February 10, 2012 to No. 85;

2) extends to the state bodies knowing questions of defense, protection of frontier, homeland security and law and order regarding inventory count and preparation of departmental registers of functions.

The unified register does not include functions of the state bodies knowing questions of defense, protection of frontier, homeland security and law and order.
