Rules of use of the strengthened qualified digital signatures during the maintaining the unified state register of civil registrations and transfer to electronic form of books of state registration of acts of civil status (assembly books)

1. These rules establish procedure for use of the strengthened qualified digital signatures when maintaining the Unified state register of civil registrations (further - the register) and transfer to electronic form of books of state registration of acts of civil status (assembly books) (further - assembly books).

2. When maintaining the register the qualified certificates of keys of verification of the digital signature created and issued accredited according to the procedure, established by the Federal Law "About the Digital Signature", certification centers (further - the accredited centers) using digital signature facilities and means of the accredited center which lists of classes are determined by the operator of federal state information system of maintaining the register according to the specified system approved as the operator in coordination with Federal Security Service of the Russian Federation model of safety hazards of information in this information system are used.

Access to federal state information system of maintaining the register is provided with use of digital signature facilities which classes contain in the list of classes of digital signature facilities determined according to paragraph one of this Item.

Ensuring verification of the digital signature with qualified certificates of keys and keys of the digital signature of employees of bodies which according to the Federal Law "About Acts of Civil Status" make state registration of acts of civil status (further - bodies of civil registration) performs the accredited center of the operator of federal state information system of maintaining the register.

3. In case of transfer to electronic form of assembly books the qualified certificates of keys of verification of the digital signature created and issued by the accredited centers are used.

4. The keys of the digital signature used for forming of the strengthened qualified digital signature in case of transfer to electronic form of assembly books are created by bodies of civil registration independently or according to their address the accredited center.

5. For the purpose of transfer to electronic form of assembly books creation of the keys of the digital signature used for forming of the strengthened qualified digital signature is performed by bodies of civil registration and the accredited center with use of the digital signature facilities having confirmation of conformity to the requirements established by Federal Security Service of the Russian Federation.

6. Use of the strengthened qualified digital signature by employees of bodies of civil registration when maintaining the register and in case of transfer to electronic form of assembly books is performed with observance of obligations, the stipulated in Article 10 Federal Laws "About the Digital Signature".

7. After signing of the electronic document (packet of electronic documents) by the employee of body of civil registration within maintaining the register and (or) transfer to electronic form of assembly books the operator of federal state information system of maintaining the register or the operator of information system of body of civil registrations or information system of executive body of the subject of the Russian Federation or administration of Baikonur whose competence includes the organization of activities for state registration of acts of civil status in the territory of appropriate subject of the Russian Federation or Baikonur (further - executive body of the subject of the Russian Federation or administration of Baikonur) in which according to item 4 of article 77.1 of the Federal law "About Acts of Civil Status" civil registrations are stored, converted (transformed) into form of an electronic document (further - information system of body of civil registration), shall perform the strengthened qualified digital signature with which use the specified electronic document (packet of electronic documents) is signed.

8. When obtaining according to the Translation rules in electronic form of books of state registration of acts of civil status (assembly books) approved by the order of the Government of the Russian Federation of March 3, 2017 No. 254 "About approval of Translation rules in electronic form of books of state registration of acts of civil status (assembly books)" (further - Translation rules), from executive body of the subject of the Russian Federation or administration of Baikonur of copies of the civil registrations converted (transformed) into form of an electronic document, the operator of federal state information system of maintaining the register shall perform the strengthened qualified digital signatures with which use the specified copies of civil registrations are signed.

9. The verification of the strengthened qualified digital signature provided by Items 7 and 8 of these rules includes check of observance of conditions, the stipulated in Clause 11 Federal Laws "About the Digital Signature".
