According to the Presidential decree of the Republic of Uzbekistan of April 21, 2017 No. UP-5024 "About Enhancement of System of Public Administration in the Sphere of Ecology and Environmental Protection" and the resolution of the President of the Republic of Uzbekistan of April 21, 2017 "About measures for providing the organization of activities of the State committee of the Republic of Uzbekistan for ecology and environmental protection", and also for the purpose of further increase in efficiency of use of the money allocated for strengthening of nature protection activities, timely and effective realization of the major priority directions for providing ecological safety in the republic, the Cabinet of Ministers decides No. PP-2915:

1. Approve Regulations on procedure for forming and use of fund of ecology, environmental protection and the address with waste (further - Fund) according to appendix No. 1.

2. Accept the offer of the State committee of the Republic of Uzbekistan on ecology and environmental protection and the Ministries of Finance of the Republic of Uzbekistan about:

the direction of balances in cash republican and local funds of conservation in Fund;

covering by fund of accounts payable of Committee of the Republic of Karakalpakstan on ecology and environmental protection, managements on ecology and environmental protection of areas and the city of Tashkent before the budget and creditors according to Programs of the research, nature protection and organizational actions financed by means of local funds of conservation.

3. Make changes to some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

4. Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 3.

5. To the state committee of the Republic of Uzbekistan on ecology and environmental protection and other interested ministries and departments to bring the regulatory legal acts adopted by them into accord with this resolution in a month.

6. To impose control of execution of this resolution on the chairman of the State committee of the Republic of Uzbekistan on ecology and environmental protection Kuchkarov B. T. and Information analysis department concerning health care, ecology, environmental protection, physical culture and sport of the Cabinet of Ministers of the Republic of Uzbekistan.

Regulations on procedure for forming and use of fund of ecology, environmental protection and the address with waste

Chapter 1. General provisions

1. This Provision determines procedure for forming, use and management of fund of ecology, environmental protection and the address with waste of the State committee of the Republic of Uzbekistan on ecology and environmental protection (further - Fund).

2. The fund is not legal entity and performs financing:

the nature protection projects and actions directed to preserving and reproduction of bioresources, carrying out research activities in the sphere of ecology, environmental protection and the address with waste, implementation of monitoring of the environment, organizational works on ecological promotion and education, preparation, retraining, advanced training of specialists;

other purposes connected with realization assigned to the State committee of the Republic of Uzbekistan on ecology and environmental protection (further - Goskomecologies) tasks and functions.

Chapter 2. Sources of forming of fund

3. Fund is created at the expense of the following sources:

74 percent from the amount of compensation payments for pollution of the surrounding environment and placement of waste;

74 percent from the amount of the penalties and means collected from users of nature for damage caused to the environment by emergency volley emissions (dumpings, placement of waste) of pollutants;

40 percent from payment amount of users of nature for above-standard and not complex use (losses) of natural resources and the raw materials received from them;

40 percent of the means collected from users of nature for compensation of the damage caused to objects of the surrounding environment as a result of economic and other activity;

74 percent from the amount of the penalties and sums of money collected in administrative and legal process from the physical persons and legal entities guilty of violation of the nature protection legislation, except for the penalties and sums of money collected for the violations connected with use of objects of animal and flora;

74 percent from the amount of the penalties and money collected in administrative and legal process for violations of the nature protection legislation and according to the procedure of compensation of the damage caused to environment objects from foreign citizens, and also from legal entities of other states, except for the penalties and sums of money collected for the violations connected with use of objects of animal and flora;

74 percent from payment amount for the cabin of trees and bushes out of the state forest fund;

means of equity of legal entities in financing of joint nature protection actions;

charitable gifts of physical persons and legal entities, including charitable organizations;

means from holding ecological actions and shares;

revenues according to the income from placement to deposits of commercial banks of the Republic of Uzbekistan of temporarily available funds of Fund;

other sources which are not forbidden by the legislation.

Chapter 3. Uses of fund

4. Use of fund is performed according to annually approved program of Fund (further - the Program).

5. Fund is used on financing:

a) nature protection projects and actions, including on:

designing and construction, modernization, reconstruction and capital repairs of nature protection objects, and also the objects which are a part of the system of Goskomecology;

the actions providing compensation or the prevention of the negative consequences caused by pollution of the surrounding environment;

the carried-out works on creation and recovery of sanitary protection and water protection zones, preserving and recovery of water objects;

recovery of the natural objects broken when implementing economic and other activity, protection and reproduction of animal and flora;

actions for pest control and diseases of objects of plant and animal life;

actions for creation, expansion, ensuring activities and the mode of the protected natural territories and their arrangement;

creation of nurseries on protection and reproduction of animal and flora;
