About Council for simplification of procedures of trade in the Kyrgyz Republic

For the purpose of ensuring coordination of activities of authorized state bodies and other organizations for simplification of procedures in the sphere of foreign trade and the foreign trade transportations, according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve Regulations on Council for simplification of procedures of trade in the Kyrgyz Republic according to appendix.

2. To the ministries, the state committees, administrative departments, other executive bodies, local government bodies (in coordination), to the state companies and the organizations of the Kyrgyz Republic to represent at the request of Council for simplification of procedures of trade in the Kyrgyz Republic in accordance with the established procedure necessary information and to direct experts and specialists for the solution of the questions arising in the course of work of the specified Council.

3. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About formation of National council of the Kyrgyz Republic on assistance in the sphere of trade and transport" of January 29, 2008 No. 29;

- the order of the Government of the Kyrgyz Republic "About modification and amendments in the order of the Government of the Kyrgyz Republic of January 29, 2008 No. 29 "About formation of National council of the Kyrgyz Republic on assistance in the sphere of trade and transport" of February 21, 2009 No. 135.

4. This resolution becomes effective after seven days from the date of official publication.

Regulations on Council for simplification of procedures of trade in the Kyrgyz Republic

1. General provisions

1. This Provision determines procedure for forming and activities of the Council for simplification of procedures of trade in the Kyrgyz Republic (further - Council) created within implementation of the Agreement on simplification of procedures of trade ratified by the Law of the Kyrgyz Republic of November 22, 2016 No. 183 (further - the Agreement of the WTO).

2. Council is interdepartmental advisory advisory body which activities are directed to coordination of activities of state bodies, coordination of interests of the state and business on simplification of procedures in the sphere of foreign trade and the foreign trade transportations, including, on realization of provisions of the Agreement of the WTO.

3. Council in the activities is guided by the Constitution of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic which came in the procedure established by the law into force international treaties which participant is the Kyrgyz Republic, and this Provision.

4. Council consists of the chairman, the cochairman, the secretary of Council and members of council.

5. Representatives are part of Council:

- Ministries of Economy and Trade of the Kyrgyz Republic;

- Ministries of Transport and Communications of the Kyrgyz Republic;

- Ministries of Foreign Affairs of the Kyrgyz Republic;

- Ministries of Agriculture of the Kyrgyz Republic;

- Ministries of Health of the Kyrgyz Republic;

- Ministries of natural resources, ecology and technical supervision of the Kyrgyz Republic;

- Ministries of digital development of the Kyrgyz Republic;

- Energy ministries of the Kyrgyz Republic;

- Ministries of Finance of the Kyrgyz Republic;

- The State Customs Service under the Ministry of Finance of the Kyrgyz Republic;

- The State Tax Service under the Ministry of Finance of the Kyrgyz Republic;

- Border service of the State committee of homeland security of the Kyrgyz Republic;

- The state company "The Center of " Single Window " in the Sphere of Foreign Trade" under the Ministry of Economy and Trade of the Kyrgyz Republic;

- The center for standardization and metrology under the Ministry of Economy and Trade of the Kyrgyz Republic;

- business communities which activities are connected with implementation of foreign economic activity and/or provision of the accompanying services, with work experience in this sphere at least 3 years.

The number of representatives from business community shall not exceed the number of members - representatives of state bodies of the Kyrgyz Republic.

6. The representatives of business communities applying for membership in Council shall present to the secretary of Council the candidacies and information characterizing activities of the organization represented by them including indicators of foreign trade activity, and results of work in the respective sphere, including participation in interaction with state bodies in case of the solution of the questions connected with foreign economic activity.

7. The chairman of the board is the Minister of Economy and Trade of the Kyrgyz Republic, the cochairman - the representative of business community.

8. The structure of Council affirms the Chairman of the Cabinet of Ministers of the Kyrgyz Republic according to the offer of the Ministry of Economy and Trade of the Kyrgyz Republic.

9. Organizational and methodical ensuring activities of Council performs the Secretariat of Council. Obligations of the Secretariat of Council are assigned to the Ministry of Economy and Trade of the Kyrgyz Republic.

The secretariat of Council consists of seven members, including the secretary of Council. Representatives of business community and experts can be part of the Secretariat of Council. The structure of the Secretariat of Council affirms the Ministry of Economy and Trade of the Kyrgyz Republic.

10. For ensuring effective activities of Council with the decision of Council the working groups of number of specialists of authorized state bodies, representatives of private sector, experts can be created.

Authorized state bodies appoint coordinators of Council for operational interaction with the Secretariat of Council.

11. Financing of activities of the Secretariat of Council, and also working groups is performed within the means provided to the ministries and departments in the republican budget and also due to voluntary financial and technical assistance of the international organizations and business community.

2. Main objectives and rights of Council

12. The main objectives of Council are:

- ensuring coordination and interaction of authorized state bodies on implementation of measures for simplification of procedures in the sphere of foreign trade (export, import, transit) and the foreign trade transportations, including on realization of provisions of the Agreement of the WTO;
