Chapter I. General provisions

Article 1. Sphere of regulation

(1) This law regulates the organization and functioning of system of official statistics and establishes the legal basis of development, production, distribution and coordination of official statistics.

(2) This law extends to producers of official statistics and users of official statistical information, respondents, and also to suppliers of data.

Article 2. Legal basis

(1) the Legislation on official statistics includes this law, other regulations, and also the international agreements in the field which party is the Republic of Moldova.

(2) the Provisions of other legal acts relating to official statistics are applied in that measure in which they do not contradict this law.

Article 3. Basic concepts

In this law the following concepts are used:

depersonalization of individual data - processing of individual data so that it was impossible to identify physical person or legal entity to which these data belong;

statistical inspection – the process of knowledge of the mass phenomena relying on statistical techniques since collection of individual and cumulative data before distribution of official statistical data;

classification – separation of set of objects into subsets on similarity or distinction according to the accepted methods;

the qualifier – the official document representing the systematized code of names and codes of classification groups and/or subjects to classification;

data collection – questionnaires and all other methods of receipt of information from various sources, including administrative;

confidential data – the data allowing to identify directly or indirectly statistical units thereby opening individual information. To establish whether statistical unit can be identified, it is necessary to take all appropriate means which can be used reasonably by the third parties for determination of statistical unit into account;

the individual data - this, including personal, allowing to identify physical persons and legal entities;

development – the activities directed to creation, strengthening and enhancement of the statistical techniques, standards and procedures used for production and distribution of statistical information and also for development of new statistical data and indicators;

distribution - provision to users of official statistics and statistic analysis;

the supplier of data - physical person or legal entity, the holder and/or the owner of sources of administrative or private data which shall provide the data necessary for production of official statistics;

direct identification – identification of statistical unit according to its name or the address or according to public identification number;

indirect identification – determination of statistical unit by all means, others than direct identification;

statistical information – information of social, economic, demographic or ecological nature received as a result of statistical inspections and/or from sources of administrative and private data;

metadata - information on determinations, data sources, methods, classifications, quality of data describing by the standardized method data and processes of development of these data;

statistical methodology – scientifically developed rules and methods of statistical inspections;

the nomenclature sheet – the list, the brochure, the book containing the nomenclature from certain field of science, the equipment, etc. classified by certain criterion;

processing in the statistical purposes - any transaction or set of transactions which are carried out with individual data with use or without use of the automated means, including, but not limited to it, collection, registration, the organization, structuring, storage, the analysis, the current assessment, adjustment or change, extraction, studying, use, disclosure by transfer, distribution or provision by any different way, reduction in compliance or combination, archiving, removal or destruction, for the purpose of production and distribution of official statistics;

the producer of official statistics – public body / the public organization or division of that which are part of national statistical system which develop make and extend official statistics;
