About approval of Rules of record keeping and archive in bodies of the public executive service and private contractors

According to part six of article 27 of the Law of Ukraine "About the bodies and persons performing forced execution of judgments and decisions of other bodies", to Items 3 and 10 of the Regulations on the Ministry of Justice of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 2, 2014 No. 228 (with changes), I order:

1. Approve enclosed:

1) Rules of record keeping and archive in bodies of the public executive service and private contractors;

2) Nomenclature of cases of the private contractor.

2. Item 10 of the Standard regulations on department of the public executive service of the head territorial administrations of justice of the Ministry of Justice of Ukraine in the Autonomous Republic of Crimea, in areas, the cities of Kiev and Sevastopol, the Ministry of Justice of Ukraine approved by the order of April 20, 2016 No. 1183/5, registered in the Ministry of Justice of Ukraine on April 22, 2016 at No. 618/28748 (with changes), after the word "issue" to add with the word "order".

3. Bring in the Regulations on the automated system of enforcement proceeding approved by the order of the Ministry of Justice of Ukraine of August 5, 2016 No. 2432/5, registered in the Ministry of Justice of Ukraine on August 12, 2016 at No. 1126/29256 (with changes), the following changes:

Item 3 of the Section I to add 1) with the new paragraph the fifth the following content:

"Assistants to private contractors (concerning registration of the entering and outgoing correspondence, including executive documents)".

2) in the Section II:

4. To department concerning justice and homeland security of the Ministry of Justice of Ukraine (Oleynik A. N.) submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

5. This order becomes effective from the date of its official publication.

6. To impose control of execution of this order on the deputy minister of justice of Ukraine concerning executive service Shklyar S. V.

I. General provisions

1. These Rules establish procedure for documentation of activities for forced execution of judgments and decisions of other bodies (officials) (further - the decision), except the decisions containing the data which are the state secret and concerning the companies, organizations and the organizations with specific mode of activities, work with documents (further - clerical work) and the organizations of archive in district, district in the cities, city, gorrayonny, interdistrict departments of the public executive service of the relevant interregional managements of the Ministry of Justice of Ukraine, departments of forced execution of solutions of managements of ensuring forced execution of solutions of interregional managements of the Ministry of Justice of Ukraine, departments of forced execution of decisions in districts of the city of Kiev of management of ensuring forced execution of decisions in the city of Kiev of Department of the public executive service of the Ministry of Justice of Ukraine, department of forced execution of decisions of Department of the public executive service of the Ministry of Justice of Ukraine (further - bodies of the public executive service), private contractors.

Automation of engineering procedures of information processing in bodies of the public executive service and at the private contractor is provided with the automated system of enforcement proceeding (further - System) which mechanism of functioning is determined by the Regulations on the automated system of enforcement proceeding approved by the order of the Ministry of Justice of Ukraine of August 5, 2016 No. 2432/5, registered in the Ministry of Justice of Ukraine on August 12, 2016 at No. 1126/29256 (further - Regulations on the automated system).

3. Addresses of citizens (except addresses which are subject to consideration according to the procedure established by the Law of Ukraine "About enforcement proceeding" (further the Law)), or the bodies of the public executive service which arrived to the telephone "hot line" are considered by bodies of the public executive service according to the procedure, determined by the Law of Ukraine "About addresses of citizens", and the clerical work on them is conducted according to the Instruction on clerical work on addresses of citizens in public authorities and local self-government, associations of citizens, at the companies, in organizations, the organizations irrespective of patterns of ownership, in mass media, Ukraine approved by the resolution of the Cabinet of Ministers of April 14, 1997 No. 348.

4. Requests for information in body of the public executive service are reviewed according to the Law of Ukraine "About access to public information".

5. The clerical work in bodies of the public executive service and private contractors is conducted in state language.
