RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

Some questions of enhancement of management in the field of use and protection of lands of agricultural purpose of state-owned property and the order them

The Cabinet of Ministers of Ukraine decides:

1. Approve the Strategy of enhancement of management in the field of use and protection of lands of agricultural purpose of state-owned property and the order by them which is applied.

2. Bring in resolutions of the Cabinet of Ministers of Ukraine of August 20, 1993 No. 661 "About approval of the Regulations on monitoring of lands" (the joint venture of Ukraine, 1994, No. 1, Art. 5; Official Bulletin of Ukraine, 2003, No. 52, Art. 2809; 2011, No. 79, Art. 2916; 2012, No. 32, the Art. 1191) and of October 17, 2012 No. 1051 "About approval of the Procedure for maintaining the State land cadastre" (The Official Bulletin of Ukraine, 2012, No. 89, Art. 3598; 2016, No. 2, the Art. 102, No. 25, the Art. 992) changes which are applied.

3. To the Ministry of Agricultural Policy and Food together with Public service concerning geodesy, cartography and the inventory to develop and submit for consideration of the Cabinet of Ministers of Ukraine:

in two-month time draft of the resolution of the Cabinet of Ministers of Ukraine on modification of the Standard agreement of lease of land;

in six-months time drafts of the corresponding regulatory legal acts directed to strategy implementation, approved by this resolution.

General part

For today there is urgent need for determination of the effective controling mechanism in the field of use and protection of lands of agricultural purpose of state-owned property, prevention of abuses, non-admission of social tension in this sphere.

Ukraine has considerable land and resource potential. As of January 1, 2017 the land fund of Ukraine constitutes 60,3 of one million hectares, or about 6 percent of the territory of Europe.

Agricultural holdings constitute about 19 percent all-European, including ploughland - about 27 percent. The indicator of the area of agricultural holdings per capita is the highest among the European countries and constitutes hectare 0,9, including ploughland hectare 0,7 (average value of the European countries - hectare 0,44 and 0,25 respectively).

In general the area of farmlands constitutes 42,7 of one million hectares, or 70 percent of the area of all territory of the country, and arable land - 32,5 of one million hectares, or 78,4 of percent of all agricultural holdings.

The area of chernozems in Ukraine constitutes from 15,6 one million to 17,4 of one million hectares, or about 8 percent of world reserves.

At the same time in structure of land resources of the country and land use considerable disproportions which deepening can pose threat to the environment and the vital circle, and also efficiency of economic activity, to sustainable development of national economy in general are observed.

In Ukraine over 92 percent of the territory are attracted to economic use. Level of raspakhannost of the territory is very high and constitutes more than 54 percent (in developed countries of Europe - does not exceed 35 percent). The actual amount of forests of the territory of Ukraine makes only 16 percent that it is not enough for ensuring ecological equilibrium (average value of the European countries - 25-30 percent).

Excessive plowing of lands (more than 54 percent of land fund of Ukraine), including on slopes, led to violation of ecologically balanced ratio of agricultural holdings, the woods and reservoirs that negatively affected stability of agrolandscapes and caused considerable technogenic load of the ecological sphere.

In Ukraine there is more 1,1 of one million hectares degraded unproductive and tekhnogenno the contaminated land which are subject to preservation, 143,4 of one thousand hectares of the broken lands requiring recultivation, and 315,6 of one thousand hectares of the unproductive grounds needing improvement.

The most essential factor of decline in production of lands and growth of degradation of agrolandscapes is water erosion of soils.

Total area of the agricultural holdings submitted harmful influence of water erosion constitutes 13,3 of one million hectares (32 percent), including 10,6 of one million hectares of arable lands. As a part of bald-headed lands there is 4,5 of one million hectares with average and silnosmyty soils, including 68 thousand hectares completely lost humus horizon.

Intensively processes of linear washout and ravines develop. The area of ravines constitutes 140,4 of one thousand hectares, and their quantity exceeds 500 t. Intensity of erosion in separate ravine and beam systems exceeds average values at 10-20 times.
