This Law determines procedure and the bases of recognition of person by the refugee in Turkmenistan, provisions of additional and temporary protection in Turkmenistan, legal status of persons to which are provided the status of the refugee, additional and temporary protection, establishes legal, economic and social guarantees of protection of the rights of persons to which are provided the status of the refugee, additional and temporary protection in Turkmenistan.

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) the refugee – person who owing to quite reasonable concerns to fall victim of prosecutions on the basis of race, floor, religion, nationality, belonging to certain social group or political convictions is in Turkmenistan which cannot use protection of the country or does not wish to use such protection owing to such concerns or, without having certain nationality and being out of the country of the former regular residence as a result of similar events, cannot or does not wish to return to it owing to such concerns;

2) person petitioning for provision of the status of the refugee – the foreign citizen or the stateless person (further – person) which arrived to the territory of Turkmenistan or staying in the territory of Turkmenistan legally who declares desire to be acknowledged refugee on circumstances, the stipulated in Article 10 these Laws;

3) the interim certificate on registration of the petition for provision of the status of the refugee – the document of the established sample proving the identity of person petitioning for provision of the status of the refugee, and confirming legality of stay of this person in the territory of Turkmenistan during consideration of the petition;

4) the status of the refugee – the legal status of person recognized as the refugee in Turkmenistan, determined by the legislation of Turkmenistan;

5) the certificate of the refugee – the document of the established sample proving the identity of person to whom the status of the refugee in Turkmenistan is provided;

6) the travel document of the refugee – the document of the established sample, the right to the departure from Turkmenistan granting to the refugee and entry into Turkmenistan and proving his identity outside Turkmenistan;

7) additional protection – set of the rights and obligations of person on whom the decision on refusal in provision of the status of the refugee in Turkmenistan and is made on provision of additional protection in Turkmenistan;

8) the interim certificate on registration of the petition for provision of additional protection – the document of the established sample proving the identity of person petitioning for provision of additional protection, and confirming legality of stay of this person in the territory of Turkmenistan during consideration of the petition;

9) the certificate of provision of additional protection – the document of the established sample proving the identity of person to whom additional protection in Turkmenistan is provided;

10) temporary protection – set of the rights and obligations of persons which arrived to Turkmenistan in the emergency mass procedure which provides temporary protection in Turkmenistan;

11) the registration certificate of person to which temporary protection – the document of the established sample proving the identity and confirming registration of person to whom according to the procedure, established by the legislation of Turkmenistan, temporary protection is provided is provided;

12) the place of temporary residence – the premises provided for temporary residence in the territory of Turkmenistan of persons petitioning for provision of the status of the refugee or additional protection, and also persons to whom the status of the refugee or additional protection, and members of their families are provided;

13) temporary accommodation center – the collection points for persons and members of their families created near Frontier of Turkmenistan for temporary residence to which according to the procedure, established by the legislation of Turkmenistan, temporary protection is provided;

14) the safe third country – the country in which to person it can be provided or the shelter or the status of the refugee, and also opportunity to use protection of the state were granted;

15) family members – the spouse (spouse), in scrap with which (which) the face consisted before departure from the state of civil accessory or the former regular residence, the children (including adopted) who did not reach eighteen-year age and not married; the disabled children (including adopted) who reached eighteen-year age, not married and being dependent on person disabled parents with whom person lived jointly and conducted general economy in the state of civil accessory or the former regular residence;

16) reunion of family – arrival in Turkmenistan of family members for cohabitation with person to whom according to the procedure, established by this Law, it is provided it (is provided) the status of the refugee or additional protection;

17) the minor without maintenance – the minor who arrived to Turkmenistan without the legal representatives or family members, responsible for it, who reached eighteen-year age and who voluntarily took maintenance responsibility of the minor family member, and also after arrival in Turkmenistan left without guardianship and custody in accordance with the established procedure;

18) the list of places of temporary residence – the list of premises determined according to the legislation of Turkmenistan for temporary residence of persons and members of their families to which it is provided it (is provided) the status of the refugee or additional protection in Turkmenistan.
