About approval of minimum rates of award for some types of use of works

1. Approve enclosed:

1) minimum rates of award for use of works by public performance;

2) minimum rates of award for use of works by the public message;

3) minimum rates of award for reproduction and (or) distribution of works;

4) minimum rates of award for reproduction of audiovisual works for personal reasons without the consent of the author.

2. Determine that the rates of award attached to this resolution are minimum for the types of use of works determined in them. Amount of remuneration, procedure and terms of its payment are established by the parties in the author's or license agreement signed with authors, their legal successors or the organization managing property rights of authors on collective basis.

3. To the Ministry of Justice of the Republic of Kazakhstan in two-month time to develop and approve the Instruction for application of the minimum rates of award approved by this resolution.

4. Declare invalid the resolution of the Cabinet of Ministers of the Republic of Kazakhstan of February 9, 1995 N 142 "About rates of award for public performance of literary works and art, for creation of works of arts and crafts and their use in the industry" (SAPP of the Republic of Kazakhstan, 1995, No. 6, the Art. 67).

5. This resolution becomes effective from the date of signing.
