About enforcement of provisions of the Law on the government employee with special status of the Ministry of Internal Affairs No. 288 of December 16, 2016
For the purpose of execution of provisions of part (2) Articles 12, parts (3) Articles 14, parts (12) Articles 15, parts (7) Article 16 and the subitem c) parts (1) article 53 of the Law on the government employee with special status of the Ministry of Internal Affairs No. 288 of December 16, 2016 (The official monitor of the Republic of Moldova, 2017, Art. No. 40-49, 85), the Government DECIDES:
1. Approve:
1) Regulations on development of career of government employees with special status of the Ministry of Internal Affairs according to appendix No. 1;
2) Regulations on replacement of the state positions with special status in the Ministry of Internal Affairs according to appendix No. 2;
3) Regulations on probation period of the beginning government employee with special status of the Ministry of Internal Affairs according to appendix No. 3;
4) Regulations on part-time job and conditions of combination of the state positions with special status of the Ministry of Internal Affairs according to appendix No. 4;
5) the Nomenclature of powers on employment and assignment of special ranks, and also procedure for their delegation according to appendix No. 5.
2. To impose control over the implementation of this resolution on the Ministry of Internal Affairs.

Appendix No. 1
to the Order of the Government of the Republic of Moldova of June 22, 2017 No. 460
1. The regulations on development of career of government employees with special status of the Ministry of Internal Affairs (further – the Provision) install system of single rules of passing of professional career for government employees with special status (further – personnel/employees of the Ministry of Internal Affairs) central office of the Ministry of Internal Affairs, subordinated administrative authorities and organizations of the Ministry of Internal Affairs (further – divisions of the Ministry of Internal Affairs).
2. The career of employees of the Ministry of Internal Affairs represents the sequence of posts and the positions which are taken up during professional activity from the date of emergence of the office relations and before date of their termination, depending on requirements of organization and individual knowledge, capabilities, competence and motivation.
3. Development of career includes stages which passes in individual procedure during professional activity personnel of the Ministry of Internal Affairs, and includes promotion to higher positions, assignment of the next special ranks, development of working experience and preparation, etc.
4. For the purposes of this provision the used terms mean the following:
1) officers – the employees of the Ministry of Internal Affairs having special ranks from the inspector to general kvestor;
2) subofficers – the employees of the Ministry of Internal Affairs having special ranks from the agent to the leading chief agent;
3) special check - the method of check of candidates in case of revenues to work or promotion on the state position with special status of the Ministry of Internal Affairs which is carried out by division of human resources and service of the internal protection and fight against corruption subordinated to the Ministry of Internal Affairs intended for identification and elimination of risk factors, restrictions, prohibitions and not compatibility, including establishment of conduct of life of candidates which owing to the moral and professional qualities, behavior in society, in the place of study, works can threaten public concerns, prestige of the state position with special status, safety and image of the Ministry of Internal Affairs, its divisions;
4) passing of special check – provision in case of which the result of special check is positive and the candidate can be proposed to higher position;
5) development of career – planned process of career development by passing of various hierarchical professional levels, receipts of special ranks, receipts of necessary education, passing of the established estimates, compliance to other specific criteria, stipulated by the legislation and this Provision;
6) higher position – any position with special status of higher professional hierarchical level, than the position held by the employee of the Ministry of Internal Affairs at some point;
7) management of career – set of the actions performed by the Ministry of Internal Affairs for management of professional career of personnel;
8) post – the main component of organizational structure which covers set of the functions and obligations established by organization for certain position;
9) promotion – transition according to the procedure of career development from the occupied hierarchical level on the following higher level, by the rules established by this Provision;
10) area of specialization – the certain sphere of professional activity as a part of divisions of the Ministry of Internal Affairs (public order, investigation of crimes, criminal prosecution, safety of border, civil defense, classified services) according to appendix No. 1 to this Provision;
11) rules of development of career – the minimum compulsory provisions established for occupation of higher positions;
12) specializations – separate professional types of activity in certain area of specialization for which the employee of the Ministry of Internal Affairs received special preparation;
13) divisions of the Ministry of Internal Affairs – the general name of structural units of central office, subordinated administrative authorities and organizations of the Ministry of Internal Affairs of all categories and hierarchical levels.
5. Development of career is performed on the basis of the following principles:
1) professionalism – career promotion of the competent staff having necessary knowledge and capabilities for execution of service duties;
2) equality of chances – recognition equally the rights to development of career of any person conforming to the established requirements;
3) integrity – employees ability of the Ministry of Internal Affairs without prejudice to carry out single rules throughout professional career, without abuses and to perform the behavior based on respect, objectivity and honesty without inappropriate influence and manifestations of corruption;
4) the personal liability – employees of the Ministry of Internal Affairs bear responsibility for own preparation and career planning;
5) transparency – obligation of body to make available to personnel socially significant information on positions as a part of the Ministry of Internal Affairs, about procedure for the organization and carrying out process of their replacement.
6. The provision provides specific criteria for:
1) appointments to the first position;
2) promotions to higher positions;
3) transfer to other sphere of specialization;
4) passings of certain professional hierarchical levels;
5) occupations of executive positions;
6) transfer of subofficers to officers;
7) assignments of special ranks.
7. The system of preparation to start career and development of professional career includes educational institutions of the Ministry of Internal Affairs and other educational institutions, in the country or abroad which prepare personnel for the Ministry of Internal Affairs.
8. For each category of positions the professional hierarchical level provided in the Qualifier of positions with special status and the special ranks corresponding to them according to appendix No. 3 to this Provision which employees of the Ministry of Internal Affairs shall pass for development of career is established.
9. The professional hierarchical levels corresponding to categories of the executive positions provided for officers, the following:
1) the A01 level – executive positions of the highest level which assume accomplishment of management of the increased complexity and responsibility (the chief/deputy chief: administrative authority and organization as a part of the Ministry of Internal Affairs, the main management / similar it, according to appendix No. 3 to this Provision);
2) the A02 level – executive positions of the average level which assume execution of functions on the organization, planning, coordination, check, management and management of divisions of the Ministry of Internal Affairs (the chief/deputy chief: divisions, managements / similar it, according to appendix No. 3 to this Provision);
3) the A03 level – executive positions of basic (initial) level which assume execution of functions on management of structures of the Ministry of Internal Affairs of the lowered complexity (the chief/deputy chief of department / similar to it, according to appendix No. 3 to this Provision).
10. The professional hierarchical levels corresponding to categories of the executive positions provided for officers, the following:
1) the B01 level – the executive positions requiring ownership of necessary knowledge and skills for accomplishment of tasks of high complexity (the officer, the chief expert / similar it, according to appendix No. 3 to this Provision);
