About approval of the Procedure for the organization of work on questions of internal security in bodies of prosecutor's office of Ukraine

According to requirements of Articles 9, of 16, 19 Laws of Ukraine "About prosecutor's office", Articles 1, of 20, 65 Laws of Ukraine "About prevention of corruption" and for the purpose of providing the proper organization of work on questions of internal security in bodies of prosecutor's office order:

1. Approve the Procedure for the organization of work on questions of internal security in bodies of prosecutor's office of Ukraine which is applied.

2. To provide to general inspection of the Prosecutor General's Office of Ukraine submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective from the date of its official publication.

4. To impose control of execution of this order on the first deputy and deputy attorneys general, the deputy attorney general - the Main military prosecutor, the deputy attorney general - the head of Specialized anti-corruption prosecutor's office, the head of General inspection of the Prosecutor General's Office of Ukraine, heads of regional, local and military prosecutor's offices.

Procedure for the organization of work on questions of internal security in bodies of prosecutor's office of Ukraine

I. General provisions

1. This Procedure determines the general principles of the organization of work on questions of internal security in bodies of the prosecutor's office aimed at ensuring compliance by prosecutors with the Prosecutor General's Office of Ukraine, regional, local, military prosecutor's offices, Specialized anti-corruption prosecutor's office, investigators (further - prosecutors) Oaths of the prosecutor, rules of public prosecutor's ethics, the prevention of making of actions which discredit rank of the prosecutor and can raise doubts in its objectivity, impartiality and independence, in honesty and integrity of bodies of prosecutor's office, and also on compliance with law in the field of prevention of corruption by other prosecutors.

2. To actions which discredit rank of the prosecutor and can raise doubts in its objectivity, impartiality and independence, in honesty and integrity of bodies of prosecutor's office, belong:

making of the actions containing signs of the corruption or connected with corruption offenses, other criminal offenses;

the control of vehicles is able alcoholic or drug intoxication or refusal of passing of survey for the purpose of identification of state of intoxication and failure to provide documents, confirmatory that the prosecutor was not in such condition;

non-presentation or untimely representation by the prosecutor without valid excuse questionnaires of virtue of the prosecutor;

representation in the questionnaire of virtue of the prosecutor doubtful (including incomplete) approvals;

intentional concealment of reliable information about making by other prosecutor of the actions violating the oath of the prosecutor or the requirement of the Code of professional ethics and behavior of prosecutors;

the illegal off-duty relations - use by the prosecutor of the office powers or the office status and the opportunities connected with it for benefit of the private interests or private interests of the third parties;

violations by the prosecutor of the requirements, prohibitions and restrictions established by the Laws of Ukraine "About prevention of corruption", "About prosecutor's office".

3. The organization of work on questions of internal security in bodies of prosecutor's office of Ukraine within powers is provided with the Attorney-General, his first deputy and deputies, the deputy attorney general - the Main military prosecutor, the deputy attorney general - the head of Specialized anti-corruption prosecutor's office, heads of regional, local and military prosecutor's offices, heads of independent structural divisions of the Prosecutor General's Office of Ukraine and regional prosecutor's offices.

4. Control of condition of the organization of work on questions of internal security in bodies of prosecutor's office of Ukraine is exercised by General inspection of the Prosecutor General's Office of Ukraine.

II. The main areas of work concerning internal security in bodies of prosecutor's office

1. The prevention and timely identification of violations by prosecutors of the Oath of the prosecutor, rules of public prosecutor's ethics, and also making of the corruption or connected with corruption offenses, other actions which discredit rank of the prosecutor and can raise doubts in its objectivity, impartiality and independence, in honesty and integrity of bodies of prosecutor's office.

2. Prevention of emergence of conflict of interest in activities of prosecutors, identification and elimination of other corruption risks.

3. Control of representation by prosecutors of the declaration of person authorized on accomplishment of functions of the state or local self-government is performed according to the procedure, No. 357 determined by the order of the Prosecutor General's Office of Ukraine of October 12, 2016 "About approval of the Regulations on the organization of work with personnel in bodies of prosecutor's office of Ukraine", registered in the Ministry of Justice of Ukraine on November 7, 2016 at No. 1450/29580.

Conducting office investigations on the facts of violation by prosecutors of the Oath of the prosecutor, rules of public prosecutor's ethics, and also making of the corruption or connected with corruption offenses, other actions which discredit rank of the prosecutor and can raise doubts in its objectivity, impartiality and independence, in honesty and integrity of bodies of prosecutor's office.

Carrying out according to the procedure, No. 205 determined by the order of the Prosecutor General's Office of Ukraine of June 16, 2016 "About approval of the Procedure for conducting secret check of virtue of prosecutors in bodies of prosecutor's office of Ukraine", registered in the Ministry of Justice of Ukraine on June 17, 2016 at No. 875/29005, of secret checks of virtue of prosecutors.
