Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union in case of realization by means of the integrated information system of foreign and mutual trade of general process "Ensuring information exchange concerning the cars imported on customs area of the Eurasian Economic Union and issued for internal consumption between customs authorities of state members of the Eurasian Economic Union";

The description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of foreign and mutual trade of general process "Ensuring information exchange concerning the cars imported on customs area of the Eurasian Economic Union and issued for internal consumption between customs authorities of state members of the Eurasian Economic Union";

Procedure for accession to general process "Ensuring information exchange concerning the cars imported on customs area of the Eurasian Economic Union and issued for internal consumption between customs authorities of state members of the Eurasian Economic Union".

2. Determine that development of technical schemes of structures of the electronic documents and data provided by the Description approved by this Decision, and ensuring their placement in the register of structures of the electronic documents and data used in case of realization of information exchange in the integrated information system of foreign and mutual trade are performed by department of the Eurasian economic commission which competence includes coordination of works on creation and development of the integrated information system of the Eurasian Economic Union.

3. This Decision becomes effective after 90 calendar days from the date of its official publication.

Rules of information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Ensuring information exchange concerning the cars imported on customs area of the Eurasian Economic Union and issued for internal consumption between customs authorities of state members of the Eurasian Economic Union"

I. General provisions

1. These rules are developed according to the following international treaties and acts constituting the right of the Eurasian Economic Union (further – the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The agreement of October 10, 2014 on accession of the Republic of Armenia to the Agreement on the Eurasian Economic Union of May 29, 2014;

The protocol of May 8, 2015 on conditions and transitional provisions on application by the Kyrgyz Republic of the Agreement on the Eurasian Economic Union of May 29, 2014, the separate international treaties incoming the right of the Eurasian Economic Union, and acts of bodies of the Eurasian Economic Union in connection with accession of the Kyrgyz Republic to the Agreement on the Eurasian Economic Union of May 29, 2014;

The agreement on the mutual administrative aid of customs authorities of state members of custom union of May 21, 2010;

The agreement on procedure for movement by physical persons of goods for private use through customs border of custom union and making of the customs transactions connected with their release of June 18, 2010;

The decision of Board of the Euroasian economic commission of November 6, 2014 No. 200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 No. 5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board Eurasian economic komissiiot on September 28, 2015 No. 125 "About approval of the Regulations on exchange of electronic documents in case of cross-border interaction of public authorities of state members of the Eurasian Economic Union among themselves and with the Eurasian economic commission".

II. Scope

2. These rules are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process "Ensuring information exchange concerning the cars imported on customs area of the Eurasian Economic Union and issued for internal consumption between customs authorities of state members of the Eurasian Economic Union" (further – general process), including the description of the procedures performed within this general process.

3. These rules are applied by participants of general process in case of control of execution order of procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules the condition of information object of general process is understood as property which characterizes information object at certain stage of its lifecycle and which changes in case of accomplishment of transactions of general process.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 No. 63.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide the automated exchange of data concerning the cars imported and issued for internal consumption (in free circulation) on customs area of the Union (except for the cars issued conditionally) (further – data concerning the cars imported and issued for internal consumption (in free circulation)), between authorized bodies of state members with use of the integrated information system of foreign and mutual trade according to the international treaties and acts constituting the right of the Union. Data on the vehicles classified in goods items 8701 are subject to exchange (except for subline items 870110), 8702, 8703, 8704, 8705, 8711 and 8716 (except for subline items 871620, 871680, 871690) the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union, except for the vehicles issued conditionally according to article 200 of the Customs Code of the Customs Union.

b) provide application of the unified structures of the electronic documents and data constructed on the basis of use of general data model;

c) provide representation at the request of authorized bodies of state members of information necessary for control concerning the cars imported (imported) and issued (issued) for internal consumption (in free circulation).

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of information support of control concerning the cars imported and issued for internal consumption (in free circulation);

b) procedures of submission of data concerning the cars imported and issued for internal consumption (in free circulation), at the request of the authorized body receiving data.

11. In case of performing procedures of general process, the procedures of information support of control incoming group in otonosheniye of the cars imported and issued for internal consumption (in free circulation) on customs area of the Union, exchange of the data necessary for accomplishment of control functions of authorized bodies of state members, between the authorized body representing data and the authorized body receiving data is performed.

In case of submission of data the authorized body representing data creates and represents to the authorized body receiving the data, data concerning the cars imported and issued for internal consumption (in free circulation) including changed and the cancelled data.

In case of performing procedures of general process, the procedures of submission of data incoming group concerning the cars imported and issued for internal consumption (in free circulation), at the request of the authorized body receiving data requests and receipt of data concerning the cars imported and issued for internal consumption are performed (in free circulation).
