About approval of Standard rules of revenues in special (out-of-competition) procedure to separate managerial positions of municipal service

For the purpose of realization of part 15 of article 24 of the Law of the Kyrgyz Republic "About the public civil service and municipal service", according to articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic", the Government of the Kyrgyz Republic

DECIDES:

1. Approve Standard rules of revenues in special (out-of-competition) procedure to separate managerial positions of municipal service according to appendix.

2. Recommend to executive bodies of local self-government to develop Rules of revenues in special (out-of-competition) procedure to separate managerial positions of municipal service on the basis of the Standard rules approved by Item 1 of this resolution.

3. To impose control of execution of this resolution on department of organizational and inspection work and local self-government of Government office of the Kyrgyz Republic.

4. This resolution becomes effective after ten days from the date of its official publication.

Standard rules of revenues in special (out-of-competition) procedure to separate managerial positions of municipal service

1. General provisions

1. These Standard rules of revenues in special (out-of-competition) procedure to separate managerial positions of municipal service (further - Standard rules) regulate questions of revenues in special (out-of-competition) procedure to separate managerial positions of municipal service of the Kyrgyz Republic.

2. Conditions and procedure for appointment to vacant position

2. The candidate for replacement of vacant managerial position shall conform to the qualification requirements established according to the legislation of the Kyrgyz Republic in the sphere of the public civil service and municipal service.

3. Person cannot be the candidate for replacement of vacant managerial position:

1) recognized as the judgment incapacitated or who conviction of court is forbidden to perform activities serving or to hold certain positions of the public and municipal service;

2) having the criminal record which is not removed or outstanding in the procedure established by the legislation.

4. The office of executive body of local self-government has the right to organize check of reliability of the data containing in the documents submitted by the candidate including special check on lack of criminal record, criminal prosecution, stay in the register of persons dismissed on the negative bases.

5. For identification at the candidate for replacement of vacant managerial position of knowledge and skills according to imposed qualification requirements the head of executive body of local self-government conducts interview.

During the interview personal and professional qualities of the candidate for replacement of vacant managerial position and its idea of future work, expectations, motivation come to light.

6. On interview result the head of executive body of local self-government makes appointment to vacant managerial position which is drawn up in the form of the order in accordance with the established procedure:

vice-mayors of the cities of republican value and heads of district administrations of the city halls according to the legislation on the status of the specified cities;

vice-mayors of the cities of regional and district value in the consent of the city kenesh, according to the procedure, stipulated by the legislation in the sphere of local self-government;

ayyl bashchysa (the head of ayyl) with the consent of descent of residents of the respective village.

3. The nomenclature of positions for appointment in special (out-of-competition) procedure

7. The head of executive body of local self-government performs appointment in special (out-of-competition) procedure to managerial positions:

1) mayors of the cities of republican value:

- vice-mayors; (*)

- heads of district administrations;

2) mayors of the cities of regional and district value:

- vice-mayors; (*)

3) Chapters ayyl to okmot:

- ayyl bashchysa (head of ayyl).

Note.

The position of the vice-mayor (deputy manager) of local government body includes position of the first vice-mayor (the first deputy head) of local government body in cases stipulated by the legislation the Kyrgyz Republic.
