DECIDES:

1. Approve Regulations on procedure for calculation of years of service of public service and municipal service for payment of allowances to official pay rate for long service according to appendix.

2. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About approval of the Regulations on payment procedure of length-of-service allowances to official pay rates of workers of local keneshes, ayyl to okmot, local self-government of the cities of Bishkek and Osh" of October 2, 1996 No. 457;

- the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for calculation of years of service of public service for payment of allowances to official pay rate for long service" of May 16, 2001 No. 234;

- Item 2 of the order of the Government of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic" of August 27, 2001 No. 491;

- the order of the Government of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic" of May 13, 2004 No. 356.

Regulations on procedure for calculation of years of service of public service and municipal service for payment of allowances to official pay rate for long service

1. This Provision determines procedure for calculation of years of service of public service and municipal service for payment of length-of-service allowances to official pay rates of the government civil servants and local government officers of the Kyrgyz Republic (further - employees).

2. The years of service of public service and municipal service are understood as general service life of the government employee and local government officer in state bodies and local government bodies.

Length of service for payment of the monthly allowance to official pay rate is for long service determined by the commission on establishment of working life. The structure of the commission on establishment of working life, and also procedure for its work are determined by the head of state body, local government body.

Commission session on establishment of working life is held as required, but at least once a year.

3. Payment of monthly length-of-service allowances to the government civil servants and local government officers is made differentially, depending on the general length of service granting the right to this allowance.

4. Join in the general length of service granting the right to the monthly allowance to official pay rate for long service:

- time of replacement of political, special, managerial state positions, and also time of replacement of political and managerial municipal positions;

- time of replacement of the state positions in military service, law-enforcement service and diplomatic service;

- operating time in offices of party, Soviet, trade-union and Komsomol bodies, in the ministries, departments, the companies, organizations and the organizations connected with executive functions and consisting on the government budget of the former USSR;

- operating time in the ministries, the state committees, administrative departments, the companies, organizations and the organizations connected with executive functions and consisting on the government budget of the Kyrgyz Republic during the period from August 31, 1991 to December 17, 1999;

- time of passing of retraining and advanced training by persons replacing the state and municipal positions in the direction of state body, local government body;

- labor activity on replacement of temporarily absent government civil servant and the local government officer (No. 75) is effective from the date of entry into force of the Law of the Kyrgyz Republic "About the public civil service and municipal service" of May 30, 2016;

- time of passing of conscription service in Armed Forces of the USSR and the Kyrgyz Republic;

- operating time in foreign institutions of the Kyrgyz Republic, interstate governing bodies with participation of member countries of the Commonwealth of Independent States, the Eurasian Economic Union, in the trade missions and representative offices of state bodies of the Kyrgyz Republic abroad, and also in governing bodies or executive bodies of the international organizations and associations if appointment of the employee to position in these bodies was performed by the decision of state body or the official of the Kyrgyz Republic;

- time of partially paid leave on child care before achievement of age of three years by it to the workers consisting in employment relationships with state bodies, local government bodies.

5. Calculation of years of service of public service and municipal service is made according to the corresponding lists and registers of the state and municipal positions existing during the periods of labor activity of the employee.

The periods of service in state bodies, local government bodies are set off in years of service of public service, municipal service irrespective of the fact which the category of the state and municipal position was replaced by the government and local government officer.

The entire periods of service included in years of service of the public and municipal service of the government civil servant and local government officer are summed up.

6. To the persons which for the first time arrived and which do not have length of service on the public civil service or municipal service, the years of service granting the right to length-of-service allowance are estimated from the date of revenues to work (service), except as specified, provided in Item 7 of this provision.

7. In exceptional cases other periods of work (service), experience and knowledge of which are necessary for accomplishment of job responsibilities on the replaced position of public service and municipal service, can join in years of service of public service and municipal service based on the proposal of the head of state body, local government body.
