About approval of the list of the diseases connected with impact of ionizing radiation, and Rules of establishment of causal relationship of diseases with impact of ionizing radiation

(as amended of the Order of the Government of the Republic of Kazakhstan of February 20, 2006 No. 110)

For the purpose of implementation of the Law of the Republic of Kazakhstan of April 23, 1998 "About radiation safety of the population" the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) the list of the diseases connected with impact of ionizing radiation;

2) Rules of establishment of causal relationship of diseases with impact of ionizing radiation.

3. To the Ministry of Health to bring departmental regulatory legal acts into accord with this resolution in a month.

4. This resolution becomes effective from the date of signing.

The list of the diseases connected with impact of ionizing radiation

1. The diseases having direct link with impact of ionizing radiation:

1) sharp and chronic radiation sickness;

2) beam cataract;

3) beam dermatitis and burns;

4) beam hypothyroidism;

Beam autoimmune tireoidit 5).

2. Malignant new growths:

1) sharp leukosis;

2) chronic leukoses and miyelodisplastichesky syndrome (excepting chronic limfoleykoz);

3) malignant lymphoma;

4) solid malignant new growths (cancer of lung, thyroid gland, mammary gland, malignant tumors of urinogenital system, digestive tract, gepatobilliarny zone and others).

3. All-somatic diseases:

1) diseases of thyroid gland (autoimmune tireoidit, diffusion nodal craw);

2) diseases of blood and haematogenic system (agranulotsitoz, hypoplastic and aplastic anemia);

3) diseases of cardiovascular system (coronary heart disease, hypertension);

4) degenerate and dystrophic defeats of bone and muscular system (except infectious and traumatic genesis).

4. Congenital diseases and malformations:

1) mental retardation;

2) mikrotsefaliya;

3) malformations of facial skull and bone and muscular system.

Rules of establishment of causal relationship of diseases with impact of ionizing radiation

1. Basic provisions

1. These rules are developed according to the Law of the Republic of Kazakhstan of April 23, 1998 "About radiation safety of the population" and regulate procedure for establishment of causal relationship of diseases with impact of ionizing radiation.

2. Examination of causal relationship of diseases with impact of ionizing radiation at the population of the Republic of Kazakhstan is performed central and regional interdepartmental advisory councils on establishment of causal relationship of diseases with impact of ionizing radiation (further - central and regional interdepartmental advisory councils).

3. The central interdepartmental advisory council is created by authorized body in the field of health care.

The structure of the central interdepartmental advisory council affirms authorized body in the field of health care in coordination with the interested state bodies.

4. The authorized body in the field of health care determines feasibility of creation of regional interdepartmental advisory councils, approves their structure and powers.

5. The conclusion central and regional interdepartmental advisory councils is the basis for territorial subdivisions of authorized body in the field of social protection of the population in case of determination of the reason of disability (death) connected with radiative effects.

2. Procedure for establishment of causal relationship of diseases with impact of ionizing radiation by regional interdepartmental advisory council

6. With impact of ionizing radiation citizens submit for review of causal relationship of diseases in regional interdepartmental advisory council the following documents:

1) statement;

2) the statement from medical documentation with the description of the state of health, specifying of time of the beginning of disease, frequency of aggravation, results of clinical and laboratory trials;

3) copy of the documents testimonial of temporary or permanent disability;

4) copies of the service record, orders on sending, the business trip order (for working in zone of radiation risk);

5) the copy of the certificate of effective dose taking into account radiological route of accommodation (work, study, service in Armed Forces, other troops and military forming);

6) copies of other available documents confirming accommodation (work, study, service in Armed Forces, other troops and military forming) in the area included in zone of radiation risk.

7. The regional interdepartmental advisory council considers connection of diseases with impact of ionizing radiation based on clinical and laboratory data, the size of effective dose and nature of radiation.

8. The regional interdepartmental advisory council considers the submitted documents within one month.

9. The conclusion of regional interdepartmental advisory council is drawn up in the form established by authorized body in the field of health care and signed by the chairman.

10. The regional interdepartmental advisory council sends the expert opinion to citizens within three days after consideration.

11. The regional interdepartmental advisory council following the results of half-year submits to the central interdepartmental advisory council the report on the activities.

12. The conclusion of regional interdepartmental advisory council can be appealed in the central interdepartmental advisory council within a month from the moment of obtaining.

3. Procedure for establishment of causal relationship of diseases with impact of ionizing radiation by the central interdepartmental advisory council

13. The central interdepartmental advisory council considers petitions from citizens in case of their disagreement with the conclusion of regional interdepartmental advisory council.

14. For consideration of the applications of citizens the central interdepartmental advisory council requests originals of medical documentation from regional interdepartmental advisory councils.

15. Meetings of the central interdepartmental advisory council are held at least once a quarter.

16. The conclusion of the central interdepartmental advisory council is drawn up in the form established by authorized body in the field of health care and signed by the chairman.
